Chinese administrative justice system: Its malpractice and possible reform

The arbitrary detention through coercive administrative measures in the past years is widely regarded as a major source of undermining the justice of law in China. Based on examining the deficiencies of Chinese administrative justice system, it explores the likelihood of community corrections in treating minor offenders in lieu of existing administrative detentions. Further, it concludes that a Chinese community correction system in the context of legal culture can be gradually shaped, leading to a radically social transformation, and ultimately producing a significant effect on the improvement of the rights of offenders who are accused of committing administrative misbehaviors.     

The Rhetoric and Practice of Community Corrections in China

Over the last decade, community corrections in China has operated as an intermediate sanction in response to a growing prison population. Official policy describes this punishment as an alternative to prison, focusing on risk assessment, correctional treatment, and cognitive-behavioral therapies that have been adopted in a number of Western countries. Based on interviews with community corrections officials in Shanghai, this article examines the rhetorical and practical characteristics of this new punishment and, more specifically, considers the consistencies and discrepancies between official policy and its practical implementation. It argues that, despite official policy, community corrections in China is underpinned by intensive correctional supervision that is premised on control, surveillance, and education.

目前,高校的思想政治教育的效果仍需进一步提高,而加强针对性是一个关键性环节。为了强化针对性,在培养目标上,应该认识到高等教育从精英教育发展到大众教育时,大学生的培养目标由精英——社会主义事业的“可靠接班人”,演化为有知识的普通劳动者——社会主义事业的“合格建设者”;在教学时,重视学生的实际需要,并借此来发挥学生在思想政治教育中的主体性作用;在教学内容上,注意平衡思想政治课课程中的意识形态性和科学性的关系,从而自然、有效的达到知书达理目的。
