Both the number of crime suspects without legal status and the number of irregular or undocumented immigrants held in detention facilities increased substantially in the Netherlands between 1997 and 2003. In this period, the Dutch state increasingly attempted to exclude irregular immigrants from the formal labour market and public provisions. At the same time the registered crime among irregular migrants rose. The ??marginalisation thesis?? asserts that a larger number of migrants have become involved in crime in response to a decrease in conventional life chances. Using police and administrative data, the present study takes four alternative interpretations into consideration based on: 1) reclassification of immigrant statuses by the state and redefinition of the law, 2) criminal migration and cross-border crime, 3) changes in policing, and 4) demographic changes. A combination of factors is found to have caused the rise in crime, but the marginalisation thesis still accounts for at least 28%. These findings accentuate the need for a more thorough discussion on the intended and unintended consequences of border control for immigrant crime.  相似文献

In the past decade the Dutch state and the European Union have initiated a number of measures to make the strategies of irregular immigrants more visible in order to exclude, apprehend and expel them more effectively. These measures have limited the scope of irregular immigrants to manoeuvre in the legitimate institutions of society. As a consequence irregular migrants are pushed towards the fringes of legality and beyond. This article discusses three shifts in the residence strategies of irregular immigrants: (1) from formal to informal work, (2) from legitimate to criminal behaviour, and (3) from being identifiable to being unidentifiable. In reaction to these strategies, the state is countering again with new measures, especially with instruments to identify immigrants who do not reveal their true identity. There is a constant struggle in the field of migration, in which individual and collective actors involved respond to each other with different strategies.  相似文献

Nationality swapping in sports is commonly assumed to be a rapidly expanding practice that is indicative of the marketization of citizenship. Sports are said to have become wholesale markets in which talent is being traded for citizenship. In this article, we seek to empirically explore such claims by analysing 167 athletes who have competed for two different countries in the Summer Olympic Games. It seems that most switches occurred after the 1990s. Then, following a citizenship as a claims-making approach, we introduce the work of Bourdieu so as to connect citizenship as both legal status and practice with normative claims. The analysis reveals that the practice of nationality switching is shaped by structural conditions of the Olympic field. First, a complex realm of citizenship laws and regulations produces conditions under which athletes make legitimate claims to citizenship. Second, through a mechanism of reverberative causation, prior migrations are often echoed in contemporary nationality swapping . Only a limited number of athletes acquired citizenship via the explicit market principle we call jus talenti. Claiming that instrumental nationality swapping is indicative of the marketization of citizenship obscures the complex interplay between structures of and practices within the Olympic field.  相似文献

In this article illegal immigrants, a relatively new group of immigrants living at the margins of society, are discussed. The question of the significance of crime for groups that are officially excluded from the formal labour market and public provisions, is presented within the framework of the Unknown City research project, conducted in the four largest Dutch cities (interviews with illegal immigrants; an ethnographic study to determine the extent of support by various ethnic communities; and an examination of the ways in which the restrictive policies towards illegal immigrants were implemented by the police, the Aliens Departments, and by professionals within public or semi-public institutions in the fields of education, healthcare and housing). Both the relatively limited involvement in crime in general and the differences between groups can be explained by the embeddedness of illegal immigrants in the labour sphere and the support by ethnic communities. Attention is paid to the social and legal construction of the illegal immigrant through new legislation and to the observation that illegality is increasingly linked to crime. The majority of illegal immigrants are not criminally active. One exception is the category that is active in the lower levels of the hard drug trade. The authors' analysis suggests that the perception of the criminal illegal immigrant first and foremost reflects the division between wanted and unwanted immigrants, which is the result of the shift towards a restrictive policy.  相似文献
