Social science and the Courts

Social scientists have increasingly become involved in the submission of amicus curiae or friend of the court briefs in legal cases being decided by state and federal courts. This increase has triggered considerable debate about the use of briefs to communicate relevant social science research. This article evaluates the strengths and weaknesses of various methods of summarizing social science research for the courts. It also reviews the procedures for submitting briefs developed by the American Psychology-Law Society which, in collaboration with the American Psychological Association, has submitted its first brief inMaryland v. African farmer-led irrigation development: re-framing agricultural policy and investment?

The past decade has witnessed an intensifying focus on the development of irrigation in sub-Saharan Africa. It follows a 20-year hiatus in the wake of disappointing irrigation performance during the 1970s and 1980s. Persistent low productivity in African agriculture and vulnerability of African food supplies to increasing instability in international commodity markets are driving pan-African agricultural investment initiatives, such as the Comprehensive Africa Agricultural Development Programme (CAADP), that identify as a priority the improvement in reliability of water control for agriculture. The paper argues that, for such initiatives to be effective, there needs to be a re-appraisal of current dynamics of irrigation development in sub-Saharan Africa, particularly with respect to the role of small-scale producers’ initiatives in expanding irrigation. The paper reviews the principal forms such initiatives take and argues that official narratives and statistics on African irrigation often underestimate the extent of such activities. The paper identifies five key characteristics which, it argues, contradict widely held assumptions that inform irrigation policy in Africa. The paper concludes by offering a definition of ‘farmer-led irrigation’ that embraces a range of interaction between producers and commercial, government and non-government agencies, and identifies priority areas for research on the growth potential and impact of such interactions and strategies for their future development.     

Stage model for female criminals: business school students’ perceptions of white-collar offenders

We know that half of the population in Norway is female, and we know that females represent 6% of the white-collar crime prison population. In the stage model overview, we derive percentages from the literature into the gender model to explain stepwise reduction from 50% to 6%. In our empirical research, we asked two groups of business school students to come up with their own estimates for the stages in the model for female criminals. While estimates from executive students resulted in 3% women in prison, bachelor students’ estimates resulted in 10% women in prison. The most obvious discrepancy between the research literature and our two survey groups is related to relative convictions. Based on the literature, we suggested that female defendants receive more serious convictions because they may perceive and feel more guilt for a crime, for example in terms of regret, shame and depression. Thus women may have a tendency to confess more easily. Both executive students and bachelor students disagree with this estimate of 140%, as they suggest 62% and 69% respectively. One reason for their suggestion of less serious convictions for female white-collar criminals – sometimes labelled pink-collar criminals – might be that family situation and other elements are taken into account before a verdict is passed on a woman. Another substantial discrepancy is related to detection risk. The literature suggests a low detection risk for women, but may be not as low as we estimated at 30%. Both executive and bachelor students believe that the gender difference in detection likelihood is not that formidable, as they suggest 75% and 65% respectively.

The PDS in the new German party system

The success of the Party of Democratic Socialism (PDS) cannot be explained solely with a rising tide of GDR nostalgia and/or with the efficiency of PDS members as service providers and advocates at the grass‐roots level. We stress the importance of the PDS as the main political representative of a specific socio‐economic and cultural milie in the former GDR. Furthermore, the article traces the evolution of the PDS from a populist voice of protest of the losers of unification to the beginnings of a new political party. As such it defines its identity more as a radical left‐wing party with strong social libertarian characteristics than a traditional socialist party. The party programme and the electorate of the PDS display remarkable similarities to the fundamentalist wing of the West German Greens in the 1980s, although differences as to the origins of the left‐libertarian ideas remain important. While the PDS seems to have strengthened the significance of the new politics agenda in post‐unification Germany, it is still too early to conclude whether this agenda is firmly rooted in the party or whether it is simply a vehicle to electoral success.
