It is relatively easy to characterize the institutional structureof a country as consociational or federal. The task is muchmore difficult if we turn from structure to the decision process.Within a given structure, there may be a great deal of variationwith regard to the decision process. Data for such variationare given for the decision process in Switzerland for whichthe following four types are distinguished: (1) consociationaland federal, (2) consociational and unitary, (3) competitiveand federal, and (4) competitive and unitary. Difficulties arediscussed in aggregating from such a variation to a measurefor the prevailing decision process in a country as a whole.It is suggested that the problem be disaggregated and that decisionprocesses be compared for particular issues. This article examines the effectiveness of diversionary restorative justice (RJ) conferences through the eyes of juvenile offenders. In Australia, Reintegrative Shaming Experiments (RISE) are based on Braithwaite's theory of reintegrative shaming. Previous studies, although showing that RISE reported high levels of victim satisfaction and positive changes in the attitudes of offenders, also demonstrated that it has different outcomes for juvenile offenders depending on the type of offense with which they were charged. However, the effectiveness of RISE in terms of the offenders' perceptions has not been addressed, and the impact of the offenders' perceptions about RISE still remains under investigation. Using Australian data from RISE between 1995 and 1999, this article examines juvenile offenders' perceptions on preventing reoffending, repaying the victim and society, and the degree of repentance. The data were taken from interviews with juvenile offenders to measure their perceptions after the court or RISE processing. A comparison of standard court processing effects and RISE on juvenile offending, including property crime, shoplifting, and violent offenses, was undertaken. The results from this study were somewhat inconsistent with previous research. In this study, there was no significant relationship between RJ conference and the offenders' own perceptions on the prevention of future offending. However, it was found that there were treatment effects on repaying the victim, repaying society, and the degree of feeling repentance, and that younger offenders wanted to repay the victim/society and feel repentance.  相似文献

For decades, criminological theories have emphasized the importance of strong parent-child relationships in preventing children’s delinquent behaviors (e.g., Gottfredson & Hirschi, 1990). In particular, Thornberry’s (1996) interactional theory has catalyzed studies of the critical importance of reciprocal relationships between parents and children. However, though previous studies have examined reciprocal relationships, they typically do not assess changes in those relationships over time (Wiloughby & Hamza, 2011). The purpose of this study is to evaluate how reciprocal relationships vary among parenting styles and how this variance accounts for children’s delinquency. In particular, using data from the National Longitudinal Survey of Youth 1997 Cohort study, the present study examines how the authoritative parenting style and different parent’s and child’s sexes affect the reciprocal parent-child relationship. It discovers a significant correlation between authoritative parenting styles and a reduction in child delinquency and observes how a parent’s sex influences this dynamic.  相似文献

Official polices on the appropriate government response to crimes committed by a head of state are seldom dictated by strict principles of justice. Deciding whether to bring an errant leader to justice is often influenced by political expediency. Given the number of documented cases of official abuse, there is a need to understand why some governments choose to prosecute a former or sitting head of state while others do not. Yet, few studies have been done on this subject. This study reviews 52 cases of heads of state accused of crimes and explores how their own national governments responded to such accusations. Using data culled from various documentary sources, it employs a grounded theory approach to focus on the process that drives the decision to prosecute. Analysis indicates that political legitimacy, perception of threat, political stability, and degree of politicization of the military influence the decision to prosecute. The article concludes with a discussion of the significance and implications of these findings and suggestions for future research.  相似文献

Police-probation partnerships have increased in recent years, but evaluations of such partnerships are rare. Particularly within probation agencies, such partnerships can be perceived as an abandonment of service responsibilities in favor of enforcing the law against probationers, but the views of police officers involved in these partnerships have not been examined in the past. The current study began this process by examining the perceptions of law enforcement officers in Texas. In particular, the following questions were addressed: (1) whether they experience role conflict or role ambiguity, (2) how they perceive the effectiveness of partnerships, and (3) how they evaluate the impact of partnerships on crime reduction. Three partnership patterns were identified using cluster analysis. The analysis revealed a significant relationship between the extent of partnerships and the perceptions of law enforcement officers on the partnerships. The policy implications of the findings are discussed.  相似文献

A new War on Drugs became the rallying cry during the 1986 Congressional elections. One of the major components of this war was the call for mandatory drug testing of workers. We argue that drug testing has more to do with power than with genuine efforts at reducing the consumption of illicit drugs and then proceed to analyze this expansion of power by capitalists and state managers. Contrary to Block's version of state theory, the power of capitalists and state managers expanded simultaneously. We thus conclude by calling for a partial modification of his model.  相似文献

The Savings and Loan Scandal of the 1980s was the biggest crime ever perpetrated in the United States. While several studies have examined the causes of the crime (e.g., deregulation, increase of insurance coverage to $100,000, fluctuations in the economic markets, greed), few scholars to date have studied state intervention in the industry after the crime had been committed. We explore the questions of when and how state managers intervene in the actions of the powerful by supplementing state theory with the literature on the social construction of social problems.
