New Zealand lawyers and conveyancers disciplinary tribunal cases involving vulnerable clients, 2011–2017*

ABSTRACT

This research analyses disciplinary decisions of the New Zealand Lawyers and Conveyancers Disciplinary Tribunal (NZLCDT) from 2011 to 2017 that involve vulnerable clients. Increasingly, scholarship discusses vulnerability as an ethical concept, including in the legal context. Based on published decisions, the present study inquires whether some legal clients’ vulnerability warrants special attention. Twenty-five of the 193 clients in the NZLCDT decisions qualified as vulnerable based upon age, gender, mental health/neuro-disability or immigrant status. The results may inform disciplinary bodies and inspire preventive strategies by lawyers, educators and regulatory bodies. Ultimately, this evidence-based analysis magnifies the importance of client-centred approaches to risk reduction in legal practice.

Censorship intensified in Ukraine during Leonid Kuchma's second term as president, and analysts often use this as an indicator of the country's democratic backsliding. This article looks at the motivations behind the media muzzling and questions its effectiveness given that the country exploded in revolution in late 2004.     

Determination of MDMA, MDA, MDEA and MBDB in oral fluid using high performance liquid chromatography with native fluorescence detection

This paper describes the analytical methodology for the determination of MDMA, MDA, MDEA and MBDB in oral fluid. After a liquid–liquid extraction, the analysis was carried out by high performance liquid chromatography (HPLC), with fluorescence detection. The detector wavelength was fixed at 285 nm for excitation and 320 nm for emission. The mobile phase, a mixture of phosphate buffer (pH = 5) and acetonitrile (75:25), and the column, Kromasil 100 C8 5 μm 250 mm × 4.6 mm, allowed good separation of the compounds in an isocratic mode in only 10 min. The method was validated and showed good limits of detection (2 ng/mL) and quantitation (10 ng/mL) for all the amphetamine derivatives. No interfering substances were detected. A stability study of these compounds in oral fluid stored at three different temperatures (−18, 4 and 20 °C) over 10 weeks was conducted, showing a time-dependent degradation of the four compounds.     

Exile

Marta Raquel Zabaleta's autobiographical piece takes us through the trajectory of her exile as an Argentinian refugee, first in Glasgow and then in London. Forced to flee with her husband, a Chilean UN refugee, she describes the differences between the ways her husband and herself were treated by those in solidarity groups and other aid organizations and the particular difficulties faced by women refugees. She explores the isolating effects of having her professional identity and status erased as a refugee and of being relegated to the sole status of ‘wife’. Zabaleta also insists on the fundamental rights of refugees and asylum seekers to have both their histories and their desires for the future acknowledged by those in the host country.     

How citizenship matters (or not): the citizenship–belonging nexus explored among residents in Oslo,Norway

This article sheds light on what citizenship means for individuals’ experiences of belonging. Through 41 interviews conducted in Oslo, Norway, we trace understandings of how, when and why citizenship matters (or not) for belonging. Our interviewees fall into one of four categories: born citizens; naturalized citizens; dual citizens and non-Norwegian citizens who would qualify for naturalization, thus mixing participants with and without immigrant backgrounds. We interpret individuals’ experiences evaluating whether formal citizenship is explicitly or implicitly salient and whether it is associated with secure or insecure belonging. We find that citizenship matters for security and recognition, both linked to belonging, in expected and unexpected ways. Our findings point to how, when and why citizenship matters (or not) for belonging, constituting the citizenship–belonging nexus. Here, race continues to matter, as does the materiality of the passport document, in how the citizenship–belonging nexus interacts with the nation as locus of membership for citizens.
