Baker & McKenzie''s regular article tracking developments in EU law relating to IP, IT & telecommunications

This is the latest edition of Baker & McKenzie's column on developments in EU law relating to IP, IT and telecommunications. This article summarises recent developments that are considered important for practitioners, students and academics in a wide range of information technology, e-commerce, telecommunications and intellectual property areas. Libertarian Traditions: F.A. Hayek and John Anderson

An examination of John Anderson's work in relation to other political theorists of his time would help to provide a more adequate assessment of one of the “greats” of Australian intellectual and cultural life. Comparisons between Anderson's libertarian strain and F.A. Hayek's have been noted but there has been no real attempt to draw out the real differences arising from their substantive theoretical positions. Anderson and Hayek rejected any notion of a single, complete ethical code; they despaired at the demoralising effects of a culture of dependence and irresponsibility; they rejected the ameliorative liberalism represented by T.H. Green and Bernard Bosanquet. But they disagreed centrally in their assessments of those practices and movements which act as sites of resistance to the levelling standards and values of commercial and consumerist institutions.     

Rational Choice and Politics

The rational-choice approach brings scientific deductive methods to bear on politics. Appropriate methods are derived from physics, when actors interact probabilistically but non-rationally, and from game theory when they interact rationally. Collective action problems occur in the provision of public goods. As policies are themselves public goods, this leads to the game-theoretic analysis of voting, bureaucracy and lobbies. It is inconsistent to believe that economic actors are basically self-interested but that political actors are not. Rather, one should treat people as equally (not necessarily wholly) self-interested in each sphere. The paradoxes of social choice are then shown to have important implications for political science.     

Post-mortem human reproduction: legal and other regulatory issues

Increasingly women are seeking to establish pregnancies using sperm retrieved from their dead or dying partners. This raises a number of issues of a broad nature, but is also of significance in terms of the relationship between regulatory mechanisms and private choices. This article reviews this relationship with specific reference to the United Kingdom position, but also taking account of case law and regulation in Australia, particularly in the State of Victoria.
