According to David Garland (1990) scholars should be concerned about the cultural foundations of punishment in modern western society, such as religion. To this end, Garland conceptualizes punitive mentalities and sensibilities that provide the cultural support for structural systems ofpunishment. Punitive mentalities are ways of thinking about punishment, whereas punitive sensibilities are ways of feeling about punishment. Garlandsuggests that religious traditions are an important source of punitive mentalities and sensibilities. This research is an empirical analysis ofpunitive mentalities and their cultural roots, using qualitative research.Research questions focus on the following: Are there distinctively punitivementalities? How do punitive mentalities influence the desire for officialpunishment? Data from a previous study (Cook, 1998a) are analyzed here to explore terrains of punitive mentalities within the contexts of Christianity.Findings identify four distinct categories: anti-punitive, non-punitive,retributive and vengeful mentalities where Christian (non)belief systemsare important cornerstones. Much of the existing formal work on war models the decision to go to war as a game-ending, costly lottery. This article relaxes this assumption by treating war as a costly process during which the states run the risk of military collapse. The model also allows for uncertainty over either the cost of fighting or the distribution of power. The analysis makes four contributions to the growing costly-process literature: (i) the present model provides a more general treatment of the learning process that occurs when states are uncertain about the distribution of power, (ii) it explicitly compares the bargaining and learning processes for the two different sources of uncertainty, (iii) it suggests a way to empirically distinguish wars arising from these two sources, and (iv) it shows that the equilibrium dynamics of informational accounts of war may be quite sensitive to the underlying bargaining environment through which information is conveyed .  相似文献

It is argued here that development studies tend to ignore the ways in which external interventions become embedded within existing fields of power and are influenced by past experiences. This explains to a large extent the failure of many so-called ‘participatory’ programmes. Crucial changes introduced by the Mexican Agrarian Law in 1992 are examined, with particular reference to the impact and grassroots perception of new ‘participatory’ styles of government intervention. The latter process is illustrated by means of peasant–state interaction on an ejido in Jalisco, where ‘local participation’ that is central to government programmes ‘imposed from above’ reinforces stereotypes such as the ‘corrupt’, ‘ignorant’ official and the ‘lazy’, ‘distrustful’ peasant. Accordingly, encounters between state officials and smallholding peasants in the ejido display a combination of trust/distrust and cooperation/resistance.  相似文献

Sommaire: L'évaluation de la performance des organisations chargées de la prestation des services publics est le plus souvent abordée par le biais de l'analyse des programmes. Cette démarche s'applique difficilement à l'appréciation du degré de réalisation de la mission qui leur est confiée. L'analyse de la problématique du secteur de la justice permet de dégager les trois grands objectifs qui devraient être poursuivis par les systémes judiciaires. 11s ont trait à la qualité de cette justice, à l'accessibilité et à la célérité avec laquelle elle est rendue. Cette problématique est illustrée à partir du cas de l'appareil judiciaire québécois, défini ici cornme un système d'action. Les conditions de réalisation de la mission des systémes judiciaires sont présentées à partir de cet exemple. Divers moyens de mesurer le degré d'atteinte des objectifs sont ensuite dégagés. Enfin, une série d'indicateurs est définie pour certains d'entre eux. Abstract: The evaluation of the performance of public organizations is generally done through program analysis. But another approach should be used to measure the level of achievement of the mission assigned to an institution such as the court system. In this article, we tried to determine how the performance of the judicial apparatus might be evaluated. We considered that the mission of this apparatus refers to three fundamental objectives: the quality of justice, its accessibility, and the absence of undue delays. Referring more specifically to the case of the Quebec judicial system, we examine how the degree of achievement of these objectives might be evaluated.  相似文献

An ordnance-disposal expert was killed while disposing of a cache of explosives. The likely position of the body was reconstructed by modeling the explosion as an omnidirectional emission of particles from a model of the explosion site and noting the distribution of particles on a model of a human. The applications and limitations of this method in reconstructing the events and correlation with the injuries noted at autopsy are discussed.  相似文献

A limited number of recent empirical studies suggest that inmates suffer from high rates of serious mental illness. Different explanations are offered depending on the type of institution: jail or prison. The literature is based largely on urban samples and does not offer comparisons of rates across types of institution within a single study. The present study examined a random sample of 213 jail and prison inmates in a rural state using the Diagnostic Interview Schedule (III-R). Among jail inmates there was little evidence of high rates of serious mental illness, suggesting the criminalization of mental illness may not be as evident in rural settings as urban areas. Among prison inmates, however, high rates of mental disorders were found, supporting previous findings in urban and rural jurisdictions. Implications of the findings are discussed in the context of a consolidated correctional system.  相似文献
