In Peru the power system put in place by the former PresidentAlberto Fujimori created a network of illegality in which manycrimes were committed (e.g. various forms of human rights violations,including torture, murders, arms and drug trafficking and corruption).These offences were brought to light simultaneously by distinctbut intertwined investigations. In order to prosecute and punishthese crimes a special Anti-corruption System was established,which consisted of both special investigative authorities aswell as specialized anti-corruption courts. In addition, a specialsystem of Benefits for Effective Collaboration with the Prosecutionhas been put in place covering organized crime, as well as customand terrorist offences. In this respect, negotiated justiceconstitutes a very important instrument in the hands of thestate to fight organized crime. However, the prioritizationof the principles of expeditiousness and effectiveness, togetherwith very broad powers conferred on the prosecutors, impliesthe risk of undermining other equally important principles,such as the legality of evidence (legalidad de la prueba), respectfor the rights of the defence and the principle of equalitybefore the law. Finally, the author emphasizes the role thatcould be played by public international law to facilitate internationalcooperation for securing evidence and the arrest of accusedpersons, as well as to enable Peruvian authorities to identifyand seize the proceeds of crimes.  相似文献

This paper outlines a theory of fiction by examining the shift from the basically mimetic nineteenth century to be essentially non‐mimetic twentieth century. It further argues that the contemporary novel, as herein interpreted, constitutes a bona fide expression of feminist writing.

The paper contends thatthe transformation undergone by the novel as it moved from the nineteenth century to the twentieth century bears witness to the wide ranging transformation affecting the western world today. A number of inter‐related shifts have occurred ostensibly leading the western mind into a radically new world view, or new paradigm. Indeed, our culture is steadily moving from the absolutes of traditional physics to the relativity of the new physics and quantum theory; from a “logocentric”1 to a “deconstructive”2 universe; from a fragmentary (basically static and non‐creative) to a holistic (essentially dynamic and creative) realm; from representation to holography. Inasmuch as “representation” relates to “mimesis”, this paper ultimately redefines its aim by proposing to explore a shift from a mimetic to a holographic paradigm in fiction.

The notion of the holograph is therefore essential to the paper. As herein interpreted, holography not only challenges representation, but it also devalues the linear view of time (which is central to western culture) by focusing on the “now” and thereby delving into the depths of reality — the realm of the underlying, creative forces which the western world is presently releasing. It is precisely the release of long‐repressed forces that is drastically transforming western culture. This sheds new light on the problematics of western alienation which can now be reassessed in terms of “alienation from the creative source”.

In the final analysis, the paper contends that the emerging forces are essentially feminine. This posits an ultimate, all‐encompassing shift which may be said to be leading us from a male‐oriented to a holistically‐oriented culture: a culture that celebrates the essential oneness and fundamental dynamics of Life. Since the twentieth century novel has superbly explored and expressed the emergence of these forces, the paper regards it as the epitome of feminist writing. This writing is to be viewed as practice in the sense that it expresses the very process of change it has helped foster and in which it participates: the process of integration of the creative depths of being.  相似文献

The ideological literature of jihad excludes women from combat, even though the classical doctrine of defensive jihad (jihad al-daf’) that jihadis invoke stipulates that all Muslims—men, women, children, and slaves—have an obligation to go out to fight (fard ‘ayn) in defense of their territory and their faith. Thus, the validity of the doctrine of defensive jihad is inherently linked to its universal application to all Muslims. Jihadi ideologues and leaders, however, have either purposely refrained from calling on women to make their presence felt on the battlefield as warriors or have explicitly excluded them. This article is an investigation into this lacuna in jihadi ideology. It addresses a dimension that is hardly, if ever, discussed in the academic literature, namely the jihadis’ exclusion of women from combat. This exclusion represents a gaping hole in jihadi ideology and undermines the validity of the jihadis’ defensive jihad.  相似文献

This article addresses the ways in which the systemic transformation of the former Soviet republics has been reflected in urban development in two capital cities, Minsk (Belarus) and Astana (Kazakhstan). Changes taking place in these capitals have been analysed through the prism of an ideological recycling of the socialist legacy, a concept that permits exploration of which aspects of the socialist legacy have been jettisoned and which retained, in the process of formation of a capital. The article explores the nationalising strategies adopted by Belarus and Kazakhstan and reified by various practices, including those involving the recasting of cities. These strategies, however, are analysed not as inventions of post-Soviet regimes, but as forms of structural continuity.  相似文献

How are the rights of migrant workers mobilized in non‐immigration regimes? Drawing on an ethnography of human rights NGOs in Israel and Singapore, two countries that share similar ethnic policies but differ in their political regime, this study contributes to scholarship on migrants’ rights mobilization by expanding cross‐national analysis beyond the United States and West Europe and diverting its focus from legal institutions to the places where rights are produced. Findings show that differences in the political regime influence the channels for mobilizing claims but not the cultural politics of resonance that NGOs use when dealing with the tensions between restrictive ethnic policies and the expansion of labor migration. While restraints in authoritarian Singapore operate mainly outside the activists’ circle, in the Israeli ethno‐democracy they operate through self‐disciplining processes that neutralize their potential challenge to hegemonic understandings of citizenship. Paradoxically, success in advancing rights for migrants through resonance often results in reinforcing the non‐immigration regime.  相似文献

This article is a critique of the dominant approach within the counter-terrorism (CT) community that failed to analyze IS’s trajectory as a distinct group since at least 2006. We argue that two factors account for this failure. The first concerns the Authorization for the Use of Military Force (AUMF), the law that was enacted in the wake of the 9/11 attacks, providing options to the U.S. President to authorize the use of Armed Forces “against those responsible” for the 9/11 attacks. We contend that this law served as an incentive to lump regional jihadi groups under the AQ umbrella instead of discerning their differences. The second factor concerns what we term as the “al-Qa‘ida fixation,” it has to do with a post-9/11 bias towards understanding the threat emanating from jihadi groups around the world through the lens of AQ. This translated into falsely constructing a so-called “al-Qaeda Central” in the business of ‘franchising’ its brand and cloning its violent operations by establishing regional jihadi groups that served as its “affiliates” and carried out its orders. In the post-9/11 era, these two factors fed off each other. Our critique is not meant to suggest that the CT community is expected to predict the unpredictable, and we also recognize that one gains greater clarity with the benefit of hindsight. However, we argue that had the CT community given due attention to the differences between jihadi groups, there was ample evidence in the open source realm that was pointing to IS being AQ’s bête noire, and was seeking to outbid it.  相似文献
