Retributive and Restorative Justice   总被引:2,自引:0,他引:2  
The emergence of restorative justice as an alternative model to Western, court-based criminal justice may have important implications for the psychology of justice. It is proposed that two different notions of justice affect responses to rule-breaking: restorative and retributive justice. Retributive justice essentially refers to the repair of justice through unilateral imposition of punishment, whereas restorative justice means the repair of justice through reaffirming a shared value-consensus in a bilateral process. Among the symbolic implications of transgressions, concerns about status and power are primarily related to retributive justice and concerns about shared values are primarily related to restorative justice. At the core of these processes, however, lies the parties’ construal of their identity relation, specifically whether or not respondents perceive to share an identity with the offender. The specific case of intergroup transgressions is discussed, as are implications for future research on restoring a sense of justice after rule-breaking.  相似文献

In the Post-Bretton Woods financial system (1972–2009), the United States has been able to borrow heavily from savings-rich countries like Japan and China. Its access to international capital has allowed the US to cover years of extravagant spending and to enjoy unmatched levels of power and plenty. For lenders, like Japan and China, access to the huge US export market has stimulated aggregate demand, which, in turn, has facilitated economic growth, high rates of employment, infrastructure expansion, and technological development.

Notwithstanding the mutual benefits, the massive scale of Post-Bretton Woods imbalances has placed the financial system under stress. Such macro-economic imbalances usually require a major rebalancing—either immediately through a financial crash or gradually through a “soft” landing.

The financial implosion in 2008 constituted a crash landing. To arrest the steep slide into a possible world depression, most of the leading economies, including especially the United States, have taken bold monetary and fiscal measures. However, these expansionary measures will deepen deficits and generate strong inflationary headwinds while placing pressures on currency exchange rates.

Following the 2008 financial earthquake and its wave of after-shocks, America's access to foreign capital is apt to become more restricted and increasingly expensive. This will erode one of the central structural sources of US power—its extraordinary fiscal flexibility, monetary autonomy, and global economic clout. With a weakened financial superpower, the world may become less prosperous, less stable, less predictable, and considerably more dangerous.  相似文献

The majority of research in social justice, indeed in all of social science, is incremental, has received few citations, has garnered little attention in the public, and can be viewed as dull and uninteresting by both academics and lay readers. Although often well versed in a variety of methodological techniques for testing research questions, we rarely receive explicit guidance in how to construct them in a way that is interesting, useful, and pushes theory forward. A novel “problematization” approach for constructing interesting research questions has been proposed by Alvesson and Sandberg (Constructing research questions: doing interesting research. Sage Publications, London, 2013). In this essay, I introduce the problematization method to social justice scholars in a comprehensive review and critique that identifies the benefits and limitations of the approach. Then, to provide a cursory illustration of the method in practice, I problematize the domain of retributive justice, attempting to identify potentially interesting directions for future research inquiry.  相似文献

Three studies investigated whether victims' satisfaction with a restorative justice process influenced third-party assignments of punishment. Participants evaluated criminal offenses and victims' reactions to an initial restorative justice conference, and were later asked to indicate their support for additional punishment of the offender. Across the three studies, we found that victim satisfaction (relative to dissatisfaction) attenuates people's desire to seek offender punishment, regardless of offense severity (Study 2) or conflicting reports from a third-party observer (Study 3). This relationship was explained by the informational value of victim satisfaction: Participants inferred that victims felt closure and that offenders experienced value reform, both of which elevated participants' satisfaction with the restorative justice outcome. Previous research considering reactions to injustice has focused predominantly on retributive (i.e., punitive) responses. Restorative justice, a relatively understudied concept, suggests an alternative justice response which emphasizes bilateral discussion in an attempt to reach a consensus about the meaning of the offense and how to address the transgression. The current research explores the additional contribution of restorative justice processes, examining the extent to which bilateral consensus is viewed as a fairer response to transgressions than unilateral decisions. Results show that, independent of the punishment, restorative responses are generally regarded as fairer than nonrestorative responses. And compared to punishment, which tends to be moderated by offender intent and seriousness of the harm, restorative responses are regarded as particularly fair when the involved parties share an identity. Findings suggest the importance of distinguishing retributive justice from a “restorative notion of justice”—a notion that focuses on addressing concerns over the maintenance of existing social relationships and identity-defining values.

In support of a unitary conceptualization of retributive justice (justice through the imposition of punishment) and restorative justice (justice through dialogue aimed at consensus), three studies using hypothetical and recalled experiences of victimization found that people’s endorsement of, and satisfaction with, either justice notion depends on the symbolic meaning of the transgression. In Study 1, perceiving the transgression as a status/power violation was uniquely related to the endorsement of retributive justice, whereas perceiving it as a violation of shared values was uniquely related to restorative justice. In Study 2, motivation to restore status/power was related to retributive responses, whereas motivation to restore value consensus with the offender was uniquely related to restorative responses. In Study 3, a scenario experiment, respondents called for greater additional sanction when the applied justice process (retributive vs. restorative) did not fit the salient meaning of the transgressions compared to when it did (status/power vs. values).  相似文献

Self-forgiveness is not only shaped by processes exclusively within the self, nor are its consequences limited to the self. The Handbook of the Psychology of Self-Forgiveness (Woodyatt et al. 2017c) offers a timely collection of the growing and diverse scholarship on self-forgiveness, as well as a valuable resource for researchers. More importantly, however, it also provides a launching point for further theoretical and empirical innovations. In particular, we highlight the need to further investigate the role of others in the search for self-forgiveness and ultimately, moral redemption for the self. We reflect on the evolution and conceptualization, antecedents and consequences, and application of self-forgiveness. We then suggest new avenues for research that integrate self and other perspectives to understand an individual’s journey through self-forgiveness within a broader social context. We propose that we can conceptualize self-forgiveness and forgiveness as two complementary sides of the same process toward moral repair.  相似文献

Abstract

The current study explored how gender, group membership and different emotional reactions to the crime of domestic violence predict attitudes and endorsement of restorative or retributive justice practices. The experiment consisted of a 2 (victim group membership: Muslim- or Anglo–Australian)×2 (offender group membership: Muslim- or Anglo–Australian)×2 (Sex of participant) between-participants factorial design. Anglo–Australian participants (43 men; 50 women) were randomly assigned to one of the four manipulated conditions, and completed an online questionnaire that involved viewing a short video clip of a woman describing her experience as a domestic violence victim. Results revealed strong preferences for restorative justice in dealing with domestic violence, with women supporting this practice more than men. The crime was perceived as most severe and retribution was endorsed most strongly when the victim was Anglo–Australian (i.e. an in-group member). Intra-group violence was also perceived to be a greater breach of shared Australian values than inter-group (i.e. cross-cultural) domestic violence. Emotional reactions further predicted participants' responses, with hatred predicting stronger support of retributive ideals and sympathy for the victim predicting greater endorsement of restoration.  相似文献
