Qualitative interviews with one hundred defendants in Dutch criminal cases examine whether perceived procedural justice is a relevant concern for defendants, and, if so, which procedural justice components they refer to. The study provides a point of epistemological departure from the quantitative studies dominating the field, as it assessed which components of procedural justice (if any) respondents put forward themselves rather than asking about predetermined procedural justice components. The large majority of respondents mentioned procedural justice issues themselves, and six components were at the core of their procedural justice perceptions: (1) information on which decisions are based, (2) interpersonal treatment, (3) due consideration, (4) neutrality, (5) voice, and (6) accuracy. Although these procedural justice components largely correspond with the literature, respondents thus mentioned some components more often, and others less often, than the literature would suggest. In particular, neutrality plays an important role in the Dutch legal context examined here.  相似文献

Historians have paid scant attention to Australia's enthusiastic response to the Spanish‐American war of 1898. Yet these events help us to better understand the centrality of race to Australia's national identity. Even though the Australian colonies were bound by Britain's neutrality, from Sydney to Perth Australians cheered America's decision to declare war. Many gathered outside the US consulate to offer their services as soldiers and nurses. This enthusiasm for the US cause was underpinned by an identification with fellow Anglo‐Saxons and the assumption that Filipinos and Cubans were races not yet fit for self‐government. Australians were intent on establishing their status as equal members of the governing race.  相似文献

This article examines the development of the German community in Hong Kong between the 1840s and the outbreak of the First World War. It pays particular attention to the question of how the Germans, as a minority group in the crown colony, attempted to strike a good balance between integration and segregation, cultural assimilation and dissimilation, national identity and marginalization. Through investigating their social life, missionary activities and economic activities in Hong Kong, it shows that they, on the one hand, cooperated closely with the British who were in charge of key political and economic affairs, and on the other hand worked with the local Chinese on different social stratums. Although the unification of Germany in 1870 strengthened the sense of nationhood among German people in Hong Kong, they strove to strengthen the German cultural and economic network that already existed in and around the colony, without sacrificing their business and social interests which were interwoven with those of the British and the local Chinese. It is this strategy that enabled them to survive in Hong Kong until 1914.  相似文献

The article synthesizes contributions from the recent comparative research on civil war and the case‐specific literature on Colombia to argue that too often, commentators on this conflict overlook some of its key dimensions. A comprehensive analysis shows that no fewer than six factors are fueling violent conflict in Colombia: economic forces, state weakness, landscape, U.S. policies, long‐duration and spin‐off violence, and malicious opportunism by non‐combatants. The first three are the ones that matter most. The case made here is that when analysts disregard the range and interrelat‐edness of the factors involved, the result is a distortion of reality and a tendency to support policies that will not enhance the prospects for peace.  相似文献
