Politikwissenschaft als Universitätslaufbahn: Eine Kollektivbiographie politikwissenschaftlicher Hochschullehrer/-innen in Deutschland 1949–1999

Over the last fifty years, Political Science is firmly established in the German university system. The article presents the findings of a collective biography of the discipline’s professors for the period between 1949 and 1999. The empirical study puts particular emphasis on the gender distribution among tenured Political Scientists, the age at certain stages in their academic career, and aspects of regional distribution. In addition, the paper presents quantitative data for different periods between 1949 and 1999 about the regional distribution of universities at which doctoral degrees, the ‘Habilitation’, and the chairs for Political Science were achieved. The research indicates that the vast majority of active professors of Political Science in Germany in the year 1999 will have become pensioners in 2009. The paper concludes with some speculative thoughts about the situation of the German university system in general and the question, whether the discipline will survive the ongoing university reforms as a coherent academic discipline.     

Geheime Abstimmung und Demokratiebewegung. Die politischen Ziele der Reformbewegung für das ‘Australian Ballot’ in den USA

Modern research on electoral history is based on Stein Rokkan’s evolutionary model, which was developed in studies on the history of voting rights in european countries. In this model, secret voting counts as a strong indicator for democracy. The paper discusses the close connection between secret voting and democracy from the perspective of the us-american case. In most american states secret voting — called ‘Australian Ballot’ — was introduced in the decade between 1888–98. The paper pays particular attention to the struggles to introduce secret voting in two states — Massachusetts and Louisiana — and analyses the goals of the conflicting parties. The result looks paradoxical from the standpoint of modern democratic theory: in both states secret voting found strong support by political groups and parties which wanted to get rid of the the poor immigrant and the afro-american vote. At least in the south, the Australian Ballot became an effective instrument to keep afro-americans out of political power.     

Haftung für missbräuchliche Konkursantragstellung / Haftung des Mandanten für seinen Rechtsanwalt

Die Prozesspartei muss sich (schwerwiegende) Fehler ihres Rechtsanwalts bei der Prozessführung zurechnen lassen. Den Rechtsanwalt trifft normalerweise keine Verpflichtung, die Richtigkeit der ihm von seinem Mandanten erteilten Information in Zweifel zu ziehen, solange er nicht für ihre Unrichtigkeit erhebliche Anhaltspunkte hat. Missbr?uchlichkeit eines vom Gl?ubiger gestellten Konkurser?ffnungsantrags ist anzunehmen, wenn der Schuldner oder eine andere Person mit dem Konkursantrag ungerechtfertigt unter Druck gesetzt werden oder ein verfahrensfremder Zweck erreicht werden soll.     

Schadenersatzpflicht des Antragstellers bzw seines Rechtsanwalts bei (angeblich) missbräuchlichem Konkursantrag?

Die Bestimmung des § 408 ZPO, die für mutwillige Prozessführung einen eigenen Schadenersatzanspruch statuiert, ist im Konkursverfahren nicht anwendbar; es ist aber nicht zweifelhaft, dass ein missbr?uchlich gestellter Konkursantrag eine Schadenersatzpflicht des Antragstellers bzw seines Rechtsanwalts begründen kann. Missbr?uchlichkeit eines vom Gl?ubiger gestellten Konkurser?ffnungsantrags ist anzunehmen, wenn der Schuldner oder eine andere Person mit dem Konkursantrag ungerechtfertigt unter Druck gesetzt werden oder ein verfahrensfremder Zweck erreicht werden soll.     

Keine Vollstreckbarkeit eines Beschlusses auf Urkundenvorlage

Ein Beschluss, mit dem der Streitrichter einem Antrag auf Urkundenvorlage gem § 82 ZPO stattgab, ist kein Exekutionstitel nach § 1 Z 1 EO.
