Public policy and employee ownership: Designing economic institutions for a good society

While there are many types of economic arrangements compatible with democratic institutions and smoothly functioning markets, the predominant institutional arrangement in most marked-based democracies is one where the average employee has neither a share of direct ownership nor involvement in governing the company where he works. The substance of this essay deals with recent American attempts to redesign this arrangement, focusing specifically on the employee stock ownership plan (ESOP). The way we design the ownership of our economic organizations touches issues at the heart of practical political economy. It combines the realities of practice with visions of the good society. The challenge for lawmakers, then, is to think of employee ownership not only in terms of the technical details of public policy-making but as an institutional arrangement with wide-ranging potential implications for how we see and achieve the good.

Industrial relations and manpower

This article provides the first empirical evidence on the impact of Best Value processes on local service quality, costs, efficiency and accountability. Views were obtained from a wide range of personnel involved in the pilot programme in Wales by means of a postal questionnaire and interviews. The evidence shows that so far Best Value has had a positive impact on quality and accountability but little impact on service costs. Perceptions of the impact of Best Value are significantly more positive in authorities that adopted a corporate approach to the pilot process.     

The Dead, the Law, and the Politics of the Past

This article explores the role of law in cultural and political disputes concerning dead bodies. It uses three interconnecting legal frameworks: cultural and moral ownership, commemoration, and closure. It begins with a critique of the limitations of the private law notion of 'ownership' in such contexts, setting out a broader notion of cultural and moral ownership as more appropriate for analysing legal disputes between states and indigenous tribes. It then examines how legal discourses concerning freedom of expression, religious and political traditions, and human rights and equality are utilized to regulate the public memory of the dead. Finally, it looks at the relationship between law and notions of closure in contexts where the dead have either died in battle or have been 'disappeared' during a conflict, arguing that law in such contexts goes beyond the traditional retributive focus of investigation and punishment of wrongdoers and instead centres on broader concerns of societal and personal healing.     

Functional anonymisation: Personal data and the data environment

Anonymisation of personal data has a long history stemming from the expansion of the types of data products routinely provided by National Statistical Institutes. Variants on anonymisation have received serious criticism reinforced by much-publicised apparent failures. We argue that both the operators of such schemes and their critics have become confused by being overly focused on the properties of the data itself. We claim that, far from being able to determine whether data is anonymous (and therefore non-personal) by looking at the data alone, any anonymisation technique worthy of the name must take account of not only the data but also its environment.This paper proposes an alternative formulation called functional anonymisation that focuses on the relationship between the data and the environment within which the data exists (the data environment). We provide a formulation for describing the relationship between the data and its environment that links the legal notion of personal data with the statistical notion of disclosure control. Anonymisation, properly conceived and effectively conducted, can be a critical part of the toolkit of the privacy-respecting data controller and the wider remit of providing accurate and usable data.
