The development of care technology under liability law   总被引:1,自引:0,他引:1  
It is well known that strict liability and negligence induce pareto optimal care in a most restrictive model of unilateral accidents. The paper at hand extends this traditional theorem from its static context to an intertemporal setting where tort law induces progress in care technology. This model provides a methodological framework for a general analysis of the dynamic incentives generated by alternative liability rules. One of the many possible extensions of the basic model is to allow for incomplete information. Particularly, we drop the assumption that the authority setting the due care standard under negligence is able to assess technical progress ex ante. It is shown that the dynamic incentives of the negligence rule are distorted compared to strict liability in this modified framework.  相似文献

A split-ballot experiment shows that, when people are asked how interested they are in following political campaigns, their response depends not only on the order in which the question is asked, but also on the broader electoral context in which it is posed. When asked how interested they were in following the political campaigns immediatelyafter a question about whether or not they voted in the (1982) election, people were more likely to think they were interested in the campaign, especially if they claimed to have voted, than if they were asked about it immediatelybefore the question on whether or not they voted. This order effect, however, appears to depend onwhen the questions are asked. If asked within a few weeks after the election, there is little or no order effect. But later, as the memory of the campaign fades, the order of the questions makes a sizable difference in the results. This order effect also seems to be more pronounced among better-educated respondents, suggesting that they are more likely to feel pressured by a social norm to vote and to express an interest in political affairs, not only in real life, but in the survey interview as well. The paper concludes with a brief discussion of the implications for the design of the interview schedule used in the American National Election Studies.The research reported in this paper was supported by a grant from the National Science Foundation (SES81-11404).  相似文献

In response to various pressures for change arising from the present situation, the university will have to adopt a new purpose which may be recognized as a means of increasing the capability of society for continuous self-renewal. With this new purpose in mind, the structure of the university will be determined by the concept of an integral education/innovation system for which four principal levels are considered: empirical, pragmatic, normative and purposive levels. From multi-, pluri-, and crossdisciplinary approaches, all pertaining to one systems level only, the university is expected to develop increasingly interdisciplinary approaches, linking two systems levels and coordinating the activities at the lower level from the higher level through common axiomatics. Ultimately, the entire education/innovation system may become coordinated as a multilevel multigoal hierarchical system through a transdisciplinary approach, implying generalized axiomatics and mutual enhancement of disciplinary epistemology. Current university approaches to develop interdisciplinary links between the pragmatic and normative systems levels are discussed. Finally, a transdisciplinary structure for the university is briefly outlined; its main elements are three types of organizational units—systems design laboratories, function-oriented departments, and discipline-oriented departments—which focus on the interdisciplinary coordination between the three pairs of levels in the education/innovation system, i.e., on method and organization rather than on accumulated knowledge. An important role for policy sciences is seen in the linkage between the top pair of systems levels.Dr. Erich Jantsch is currently Richard Merton Professor at the Technical University, Hanover, Germany. Changes in the wording of core measures of political attitudes in the American National Election Studies have generated a good deal of controversy about artifactual sources of change in the U.S. electorate. This research, based on several field experiments and replications, investigates the effects of using or not using various types of opinion filter questions that have appeared in the SRC/CPS series over the years. The analysis shows that the use of a filter interacts significantly with a respondent's level of education and interest in politics, particularly the latter, in determining whether a respondent will offer an opinion on a given public policy issue. But the study also demonstrates that such an interaction occurs primarily when the question about interest in politics is askedafter, rather thanbefore, a set of political issue items. In interpreting these order-and-context effects the authors develop a self-perception model of how respondents infer their interest in politics from information that isavailable in memory about their own behavior in the survey interview.  相似文献
