ABSTRACT

Copyright is inherently intertwined with the development of technology and none more so than the advent of the Internet and sharing technologies. More recently, social media platforms have become the latest challenge for copyright law and policy. This article builds on the literature that recognises the underlying conflict between copyright and social networking sites (SNSs); namely that the basic implication of copyright is the restriction of copying, whereas the ethos of social networking is the promotion of sharing. In particular, this article focuses on the disparity between the restricted acts of copying and communication to the public under copyright law and the encouragement of sharing on SNS Instagram. In doing so, it contextualises the debate surrounding copyright and social media and provides an understanding of the legal implications of using Instagram. As such this paper analyses (1) the infringement of copyright protected work on Instagram, and (2) the user-agreement and licensing of copyright material on Instagram. This study concludes that the disparity between the principles of copyright and social media lead to confusion and vulnerability of users. Therefore, it is suggested that Instagram should better inform its users of the implications of sharing third-party content as well as the terms of its user agreement. This could be done by implementing a copyright strategy, which includes a notice and takedown system as well as investing in producing educational content for users. Perhaps SNSs, such as Instagram might be more motivated to take steps to recognise intellectual property rights if they were considered Internet Services Provides such as YouTube.  相似文献

Guillermo O’Donnell’s influential work ‘Delegative Democracy’ set the discourse on a peculiar type of democracy. Lying between representative democracy and authoritarianism, the uniqueness of delegative democracy lies in its features, including an absence of horizontal accountability, strong centralised rule, individual leadership with unchecked powers, a cult figure embodying the nation and clientelist practices. While delegative democracies seem to arise out of presidential systems, Turkey, though a parliamentary system, has also displayed the distinctive features of delegative democracies. This paper identifies three characteristics of delegative democracy, which are responsible for the lack of democratic consolidation, if not the erosion of democracy itself: anti-institutionalism, an anti-political agenda and clientelism. Arguing that delegative democracy is the best concept with which to examine contemporary Turkey, the paper lays out how, post-2011, Turkey has demonstrated the three elements of delegative democracy. The final section discusses the implications of the Turkish case for scrutinising the very possibility of delegative democracy in parliamentary regimes.  相似文献

Five years on from the Tunisian revolution, Tunisia stands as the sole success story of the Arab Spring. The country since then has managed to adopt a pluralist and democratic constitution, and held three free and fair elections. Accordingly, in the eyes of several observers, Tunisia is now in the process of consolidating its new democracy. However, the reality on the ground seems much gloomier, as most recent opinion surveys suggest that there is a significant degree of dissatisfaction, not only with political parties and Parliament but also with the very institution of democracy. Nevertheless, what accounts for this change? After the collapse of the long-lasting and oppressive Ben Ali regime, how, just in five years, has Tunisians’ confidence in the democratic process changed? This article accounts for this state of affairs from a party politics view, arguing that political parties, which are the main protagonists of the consolidation process, fail to fulfill their role of acquiring legitimacy for the new regime. While party–state relations seem to be stabilized due to the inclusiveness of the constitution-making process, both inter-party relationships and the relationship between parties and society suffer from numerous flaws which, in turn, hamper the democratic consolidation process.  相似文献

Both principal Turkish political parties make extensive use of patron–client networks, but in very different ways. The CHP relies on competing local brokers and synchronous vote buying. The AKP is at the centre of a network of public and private funding turning social policy to clientelist ends. Socially anchored AKP activists link the party to voters, allowing it to target social assistance for political advantage and take credit for improvement in local conditions. The case presented in this paper provides a natural experiment suggesting that this distinction is an important explanation for the AKP’s electoral success in low-income urban areas.  相似文献

ABSTRACT

The present article aims to expand scholarship on the political role of social media by focusing on the case of Facebook and the self-determination claims of Turkish Cypriots vis-à-vis Turkey. Drawing upon a virtual ethnography of relevant Facebook sites and groups, this article scrutinises whether social media offer an innovative public platform for the politics of self-determination or on-line claims are in reality formed and negotiated in the same manner as the offline ones. The article concludes that Turkish Cypriots’ Facebook activism may very well be for strengthening their community, shielding their distinct characteristics from mainland Turkey and raising their self-esteem, rather than indicating demands for complete autonomy in the traditional political sense of the word and/or statehood.  相似文献
