Beyond proportionate punishment: Difficult cases and the 1991 Criminal Justice Act

Within six months of implementation, the Criminal Justice Act 1991, which had been hailed as the most important piece of criminal justice legislation in England and Wales for many years, was already being undermined in practice, and a new Act, which amends or even reverses some of its more progressive principles, was brought before Parliament. This paper looks at some problems of proportionality in practice — through discussion of penological principles, and through consideration of the kinds of cases which are most difficult for a desert approach. Alternative ideas are examined to see whether they could offer any better framework for penal policy and practice. Post-hegemonic regionalism in Oceania: examining the development potential of the new framework for Pacific regionalism

This article explores the early potential of the Framework for Pacific regionalism, a new political process that Pacific nations are using to establish regional development priorities. The emergence of this process is positioned within a context of a desire for a new era of Pacific-led regional development collaboration. The early outcomes of the Framework are outlined and examined. Specifically, the article questions whether it is meeting aspirations for ‘game-changing’ development goals that enjoy greater levels of ‘ownership’ amongst Pacific leaders. It also explores whether the new process canbe seen as evidence of a new era of ‘post-hegemonic’ regionalism in Oceania, characterised by a revitalisation of regional political debate; a rejection of ‘economism’; and the reassertion of indigenous and civil society concerns.     

Managing incidental findings in human subjects research: analysis and recommendations.

No consensus yet exists on how to handle incidental findings (IFs) in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are findings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed.     

Local voices on community radio: a study of ‘Our Lumbini’ in Nepal

This article explores local involvement in community radio and the changes that it has brought to the lives of ordinary people in Nepal. We argue that since Nepal's first independent radio licence was granted in 1997, community radio has become an important vehicle for popular views. Drawing on a case study of a radio series produced by a community radio station broadcasting Radio Lumbini's Hamro Lumbini (‘Our Lumbini’), this article addresses the ways in which local community involvement is currently understood and discussed by listeners and programme producers, and the implications of this involvement.
