Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. This study investigates how justice or fairness issues such as procedural justice, distributive justice, and status equity affect job satisfaction among Korean employees. Incorporating cultural values and social norms salient in Korea, the study hypothesizes that perceptions of procedural justice enhance more job satisfaction than perceptions of distributive justice among Korean employees. Another hypothesis, based on Korean employees' aspiration for higher occupational status, predicts that perceptions of status equity, i.e., occupational prestige of their current jobs relative to their human capital, also increase job satisfaction more than perceptions of distributive justice. These two hypotheses were tested with a sample of 501 full-time employees in Korea. Supporting the hypotheses, the results indicated that (i) perceptions of procedural justice produce more job satisfaction than do perceptions of distributive justice; and (ii) perceptions of status equity are the most important factor predicting job satisfaction among the three fairness issues. 人口拐卖是1995年第四次世界妇女大会以来国际社会所关注的重要的性别平等问题,是消除对妇女的暴力方面所面临的新挑战。人口盲目流动造成被拐卖的风险,以各种形式的劳动剥削(包括性剥削)为目的拐卖问题正在中国逐渐增多,女童和青年妇女的多重脆弱性,使她们成为以劳动剥削(包括性剥削)为目的的拐卖的最大的受害者。本文针对既往在人口拐卖问题上的政策空白和认识盲区,结合对女童和女青年的多重脆弱性的分析,提出综合性的防止以劳动剥削(包括性剥削)为目的的拐卖的政策建议。  相似文献

民族民间文化资源的保护、利用和开发将极大地促进西部边疆少数民族地区经济、社会、文化的进步和发展;同时,对少数民族在西部开发中的参与性发展和小康社会的全面建设都将具有现实意义。建设民族工艺村应是当前条件下实现少数民族民间文化资源保护与开发的一个有效途径。同时,民族工艺村建设可作三个层次———个体、社区、社会———和两种状态———静态的与动态的保护开发———的模式区分。建设民族工艺村过程中还有一些带有共性的问题值得注意。  相似文献

职场排斥不利于高校毕业生的角色适应和绩效提升。本研究基于资源保存理论,从职场排斥现阶段研究较少的同事角度入手,探讨同事排斥、情绪智力对新入职毕业生工作绩效的影响。研究发现:(1)同事排斥负向影响工作绩效(任务绩效、关系绩效);(2)情绪智力正向影响工作绩效(任务绩效、关系绩效);(3)情绪智力负向调节同事排斥与任务绩效的关系,即情绪智力会弱化同事排斥对新入职员工任务绩效的负面效应。  相似文献

ABSTRACT

This article explores the migration experiences of Ethiopian migrant returnees from domestic work in the Gulf countries and Lebanon. The returnees reside in the town of Girana located in Habru sub-district, North Wollo zone of Amhara region. There is much female work migration to the Arab Middle East from the town, particularly to Saudi Arabia through Muslim pilgrimage. Employing a qualitative method, the study examines how the returnee women perceived and experienced labour migration and analyzes the impacts of labour migration on childcare, family survival back home, and debt payment. The returnees made voluntary regular and irregular labour migration to the region and engaged in domestic work, which is not preferred by the host society. However, domestic work is unregulated by the labour policy of the destination countries. This made the returnees’ employment situation rather exploitative, exacerbating their vulnerability to abuses, ethnic denigration, and undermining of cultural identity.  相似文献

The purpose of this study is to investigate the relationship between social media usage for work purposes and employee job satisfaction in the public sector. Because social media is a relatively recent phenomenon, the ways in which it affects employee attitudes such as job satisfaction are not well-known. Using self-determination theory (SDT) as a framework, this study tests whether perceived competence, relatedness, and autonomy mediate the relationship between social media usage for work purposes and employee job satisfaction. Data were obtained from the Australian Public Service Commission (APSC). Overall, results generated from the structural equation models support SDT, suggesting that employees using social media for work purposes have higher self-determination and higher self-determination increases their job satisfaction. In particular, the effect of competence to job satisfaction is very high. However, while social media usage for work purposes can enhance employees’ need for autonomy and competence, it does not have any statistical effect to employees need for relatedness. In addition, social media does not have any statistical and direct effect to job satisfaction. The results suggest that social media has an indirect effect to job satisfaction.
