It Can't Happen Here,1 or Has It? Sinclair Lewis's Fascist America

Sinclair Lewis, the first American to win the Nobel Prize in Literature, anticipated many aspects of Donald J. Trump's 2016 campaign and election in his 1935 satirical dystopia, It Can't Happen Here. It was his most popular novel to date and is still satisfying, thought-provoking political theater. Lewis was influenced by growing totalitarianism in Europe, reported on by his second wife, foreign correspondent, Dorothy Thompson. Noting the power of Father Coughlin and Huey Long, among others, to mobilize a public still suffering from the Great Depression, Lewis feared a fascist takeover of the American government by democratic means. Lewis's fictional nightmare features a loutish, ignorant demagogue, who is manipulated by a sinister ghostwriter adviser. With support from a resentful League of Forgotten Men, the demagogue is elected President and quickly establishes a military, racist, and anti-Semitic dictatorship. It Can't Happen Here dramatizes the dire consequences of this takeover, which is not taken seriously at first by Lewis's newspaper editor protagonist, but then is increasingly resisted. Lewis is a social satirist in the Mark Twain tradition, and his novel is worth reading today for its suggestive parallels with current history and its good-hearted humor.

Post-termination use of licensed intellectual property by licensees

Legal and practical context: The ongoing dispute between Nokia and Qualcomm exemplifies thecomplex issues that arise when the licensor–licensee relationshipbreaks down. It illustrates that any means by which a licenseecan secure rights to use licensed IP after termination of alicence agreement can be of great commercial importance, notto mention significant economic value. If a licensee can continueto use licensed IP notwithstanding that its agreement has beenterminated, a licensor's ability to control and derive maximumeconomic benefit from its IP may be fundamentally compromised. Key points: The means available to licensees to secure such rights varydepending on the kind of IP right licensed, but there are severalcommon themes, which draw on a diverse range of legal rulesand concepts, including specific IP concepts and laws (includingthe rules relating to assignment and licensing, the exhaustionof rights, revocation and invalidation, and defences to infringementclaims), contract law and competition law. This article discussespractical implications to be considered when drafting IP licenceagreements. Conclusions: From a licensee's perspective, the termination of its licenceagreement is not necessarily the end of the road. Licenseesshould be aware of these post-termination rights when expectingto face difficult renegotiations with a licensor. From bothparties' perspectives, but particularly that of licensor, thisarticle should demonstrate the importance of drafting to avoidany uncertainty that may arise on the termination of a licenceagreement.     

Modernism,gender and consumer spectacle in 1920s’ Tokyo

A lot has been written about how, in the first decades of the twentieth century, cinema validated new perceptual structures and how these affected literary narrative. But the department store was also a vital part of the mobile spectacle of modernity. Ginza and its department stores provided experiences of urban flâneuring and visual consumption that would have important effects on gender and subjectivity. This essay focuses on three short stories published between 1922 and 1931, all set in department stores or on the Ginza: Tanizaki Jun'ichirō’s ‘Aoi hana’ (The Blue Flower, 1922), Itō Sei's ‘M hyakkaten’ (The M Department Store, 1931) and Yokomitsu Riichi's ‘Nanakai no undō’ (Seven Floors of Exercise, 1927). The stories share a radically experimental modernist form: fragmented interior monologues, montage-like juxtapositions, abrupt shifts of narrative perspective. They are also connected in their preoccupation with looking, with the drama of seeing and being seen. My analysis traces how the domain of vision becomes a place of struggle over subjectivity, how gendered visual hierarchies are undermined and at least temporarily reversed.
