Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.

相对集中行政处罚权：立法模式与制度创新

相对集中行政处罚权实践是我国行政管理体制的创新举措,已经取得了较明显的效果。但目前囿于立法层次较低,且各地规范不一,极大地阻碍了这一新生事物的进一步成长。因此我们应在统一立法和系统全面立法的基础上,尽快制定一部法律或行政法规系统规范该制度。同时加强诸如表明身份制度、说明理由制度、阅卷制度、时效制度、格式化制度、职能分离制度、案卷排他性制度等研究,以丰富和完善该处罚权的实践。     

中国经济的内部平衡与外部平衡——从国民收入账户分析中国的贸易平衡

从国民收入账户的角度,围绕宏观经济的内部平衡与外部平衡问题,分析中国贸易平衡的成因及其内、外部影响,并用计量方法进行实证.结果表明从世界各国的情况看,平均消费倾向与贸易平衡存在明显的负相关性;中国的贸易平衡状况则与其低消费、高投资的内部平衡状况密切相关,这种内、外部平衡关系的模式存在着较大的风险,缺乏一定的持续性.基于这些分析结果,提出了若干针对性的政策建议.

公安院校形象设计是公安院校寻求广泛社会支持、提高综合竞争力、满足不同社会群体心理诉求的总体规划。设计良好、有特色的高校形象,要在确立办学理念的前提下,通过行为识别系统规范学校运行,通过视觉识别系统提升学校形象,并根据情况分别采用以传播媒介为主、以交际为主、以服务为主、以自我完善为主等不同的模式。     

Managing commercial risks in open source software licensing

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. End users and resellershave to adjust their own in- and out-licensing models to accommodatethis situation.     

Competitive Liberalization,Competitive Imperialism,and Intellectual Property

Aggressive pursuit of free trade agreements (FTAs) and customs unions (CUs) by major and minor trading powers alike challenges the conventional wisdom in favor of such pursuit – competitive liberalization. An equally plausible explanation for an active bilateral and regional trade agreement policy, one which effectively de-emphasizes multilateralism, may be competitive imperialism. The protection and enforcement of intellectual property rights is one area in which new provisions, going beyond multilateral rules, are being negotiated and written into FTAs and CUs. Such provisions may yield insights into which characterization of bilateralism and regionalism – competitive liberalization or competitive imperialism – is more apt. 王兆国主席在全总十四届十三次主席团(扩大)会议上的讲话中指出,工会组织应在构建共同建设、共同享有和谐社会的进程中,充分发挥工人阶级和工会组织的积极作用,推动建设社会主义核心价值体系这个和谐文化的根本,大力推动和发展先进的工会文化,充分展现工人阶级的先进性。因此,我们应深刻认识到创建工会文化是现实的要求、是历史的选择、是未来的呼唤。创建工会文化还必须知晓工会文化的内涵、特征和作用,了解工会文化的核心,探索创建工会文化的路径,真正把共建共享的要求落到实处。     

An Analysis of the Joint Board or County Model as the Structural Basis for Effective Australian Local Governance

Australian policy‐makers continue to rely on municipal amalgamation as the main engine of structural reform in local government, despite strong evidence that it diminishes participation and representation without improving service efficiency. Several promising, but neglected alternative models of structural reform have been developed, including ad hoc resource sharing models, Regional Organisations of Councils, virtual local government, and agency models. In an encouraging response to the recent policy of enforced council amalgamations in NSW, the Shires Association of NSW (2004) has recently proposed a ‘Joint Board model’ of local governance and invited comment on this model. This article takes up this challenge and seeks to place the Joint Board model in conceptual context and evaluate its characteristics and simulated cost savings.
