Law schools are seeking ways to familiarize family law students with exciting new professional roles arising in connection with family court reform. This article describes the family law externship program at William Mitchell College of Law which includes a classroom component allowing students placed in different practice settings to compare and contrast their experiences. For a family mediator to protect his client, a third party, and/or himself from unlawfully disclosing a client's admission, the family mediator should use the principles set forth in Tarasoff v. Regents of the University of California when a threat of violence is presented by one of his clients, since many states have adopted these principles through case law and statute to protect third parties from acts of violence. The two most significant factors in determining whether to breach confidentiality are the identifiability of the victim and the likelihood of the potential physical harm. If a jurisdiction has not explicitly done so via statute, the family mediator should nonetheless follow these principles since they are likely to be adopted by that jurisdiction through case law, because the probability of a court's finding a special relationship between a family mediator and a client is relatively high.  相似文献

In this article, I argue that kin states can play major roles in international mediation processes involving their kin communities. Although kin states may be naturally biased toward their kin, kin states are sometimes actively involved in mediation processes and such involvement is even encouraged by third‐party mediators. In this study, I divide the various roles assumed by kin states in mediation into four main conceptual categories: promoter, quasi‐mediator, powerbroker, and enforcer. My analysis presumes that a kin state can use its close ties with its kin community to make third‐party mediation more successful. I support and illustrate this model using cases of kin‐state involvement in peace processes and examine both the benefits and complications that kin‐state mediation can entail. This study contributes to scholarship examining the effectiveness of biased mediators. I conclude that the role a kin state assumes in a mediation is often context‐dependent, but that third‐party mediators and the international community can use their leverage over kin states to improve the peace process.  相似文献

在国际调停领域,人们普遍认为,调停者的公正和中立有利于冲突的解决。然而近期学界有新的观点,认为若调停者偏向冲突中的某一方,将更有利于缓解冲突。对这两种相互对立的说法,作者认为调停者的偏向会影响冲突双方的心理预期,进而影响最终结果。若冲突双方中一方有极度不安全感,且处于收益框架,认为谈判会有收获,此时调停者偏向不安全感强的一方的效果要比不偏不倚的调停效果好。若弱势一方处于损失框架,担心参与调停会危害国家生存,此时调停者偏向不安全感强的一方的调停效果未必更好。在朝核危机六方会谈中,中国偏向朝鲜的立场可以使朝鲜信任中国,进而参与六方会谈,显然中国对六方会谈发挥了重大作用。然而,中国的偏向立场虽然使朝鲜乐意参与谈判,但对朝核危机的彻底解决却难以取得成效,由于中国偏向朝鲜,朝鲜认为中国的支持是不会改变的,反而使朝鲜有恃无恐,美朝双方针锋相对,各不相让,最终致使六方会谈难有进展。因此,调停者的偏向立场有利于推动冲突双方参与谈判,但不一定有利于冲突的最终解决。  相似文献

This article reports the results of two studies. The first study, based on the responses of attorneys to questions about the reasons for the success of mediators with and without prior judicial experience, shows that the capacity of the mediator to gain the confidence of the disputants was most important for mediators with and without prior judicial experience. Although certain process skills were viewed as important to the success of both former judges and nonjudges, in general, process skills were significantly more important for nonjudges than for former judges. The capacity to provide useful case evaluations, on the other hand, was significantly more important for former judges than for nonjudges. The second study, based upon attorney responses to questions about unsatisfactory mediators, reinforced the conclusions of the first study regarding the importance of confidence-building attributes. For both judges and nonjudges, the mediator's inability to gain the confidence of the parties was a major reason for his or her lack of success.  相似文献

This article makes recommendations as to “Best Practices” for the training of mediators in court‐connected settings. The authors’ findings cover issues including the design of training programs, the importance of experiential learning through role‐plays, teaching methods for adult learners, class size and length, training ethical mediators, suggested trainer qualifications, and recommended regulatory practices for administrators. Data comes primarily from an assessment of mediation training and regulation in Florida, but the findings hold insights for court‐connected mediation programs throughout the United States. Additionally, the authors highlight the benefits of a collaborative assessment approach involving all stakeholder groups and facilitating smooth implementation of any needed changes.  相似文献

In order to help the parties in mediation address their interests, concerns, and responses to the conflict, the mediator must monitor and manage his or her own inner thoughts, emotions, and feelings throughout the process lest they negatively influence the outcomes of the mediation. Peer consultation offers one approach that can be used effectively to support the mediator's inquiry into practice dilemmas and invite self-knowing that benefits the mediator as well as the parties in the mediation. The effectiveness of a group consultation process, however, depends on the development of "a holding environment" that can provide a safe and confidential space within which such an inquiry can occur. The mediation process is improved when the mediator is able to sustain relational and emotional tension within herself and between the parties long enough for new understandings and actions to develop.  相似文献

In a survey of 216 advocates in mediation, the successful mediator's ability to gain the confidence of the parties was cited as important to his or her success more frequently than were any of the skills used by the mediator to bring about agreement. This article discusses the means by which mediators gain the confidence of disputing parties. The article also discusses the different skill and attribute profiles of different successful mediators and the advocates' views of the reasons for mediator failure. The article considers the implications of its findings for mediators, trainers, and advocates, and concludes with suggestions for future research.  相似文献

This qualitative study examined multiple perspectives of participants who experienced a Victim–Offender Mediation (VOM) program in a Midwestern city in the United States. Of particular interest are the roles and skills of mediators. Data consisted of 34 face‐to‐face interviews with 37 participants including adult crime victims, juvenile offenders and their parents, mediators and representatives from referring agencies. Insider perspectives regarding the roles and skills of the mediators in restorative processes were revealed through personal stories. Although the majority of the participants reported that the roles and skills of mediators were consistent with restorative justice principles, this exploratory study also revealed that some roles and skills exhibited by mediators were inconsistent with restorative justice values, which shows the variance of ‘real world’ restorative justice. Recommendations are made to promote mediators’ roles and skills that are compatible with restorative justice principles.  相似文献
