我国加入WTO对政府职能转变提出了更为迫切的要求。政府转移出来的职能 ,一部分需要中介组织来承接。对于我国中介组织发展中存在的问题 ,解决的关键在于深化改革     

The European airline industry: law and economics of low cost carriers

This article offers an analysis of the European airline industry in order to understand the new dynamics of the competitive field. The liberalization process did not lead the entrance of competitors similar to incumbents, but a new organizational model has been developed, the one of low cost carriers. The incumbents’ reaction to the liberalization process coupled with the entrance of low cost companies into the sector are hence considered. Two theories are analysed: the contestable markets theory, to understand the theoretical vision that has influenced the liberalization process, and the core theory, a modern approach to the concept of destructive competition that, according to some authors, is a recurring problem in the sector. While numerous barriers to entry still exist, the paper examines how the organizational model of low cost companies has helped new entrants to overtake these obstacles. By the same token, the application of the core theory does not seem to justify strategic alliances taking place in these years. The competitive framework is definitely clearer if we analyse sector changes in a different way, from the point of view of low cost companies considered as new market actors.     

PREDICTING WHO REOFFENDS: THE NEGLECTED ROLE OF NEIGHBORHOOD CONTEXT IN RECIDIVISM STUDIES*

Prior studies of recidivism have focused almost exclusively on individual‐level characteristics of offenders and their offenses to explore the correlates of reoffending. Notably absent from these studies are measures reflecting the neighborhood contexts in which individuals live. The current research addresses this shortcoming. Using data on a sample of ex‐offenders in Multnomah County, Oregon (Portland and surrounding area) in conjunction with 2000 census data, we answer two questions. First, which individual‐level factors influence rates of recidivism? Second, to what extent does neighborhood socioeconomic status account for variation in the reoffending behavior of ex‐prisoners that is not explained by their individual‐level characteristics? We find that those who return to disadvantaged neighborhoods recidivate at a greater rate while those who return to resource rich or affluent communities recidivate at a lesser rate, controlling for individual‐level factors.     

入世对经济犯罪的影响及对策

入世后我国经济犯罪将表现出以下特点:1.犯罪主体和犯罪对象将变得复杂;2.金融犯罪将增加;3.侵犯知识产权犯罪将日益受到重视;4.跨境犯罪、中介型犯罪增加。为此,应采取以下对策:1.提高对入世重要性的认识,认真学习世贸知识;2.积极调研入世后的犯罪形势,提高监控能力;3.加强力度,打击突出经济犯罪;4.加强国际警务合作,打击跨境跨国经济犯罪。     

现行出入境管理法律冲突问题研究——以法律条文为分析对象

现行出入境管理法律制度存在诸多冲突问题,主要表现为与国际法之间的冲突问题,与宪法、立法法、行政处罚法及刑法等法律之间的冲突问题,与行政许可法、行政复议法、行政诉讼法等法律之间的冲突问题及出入境管理法律制度相互之间的冲突问题。要解决这些冲突,完善立法是关键。     

自动消色笔书写笔迹显现方法的实验研究

目的为自动消色笔书写笔迹的显现识别提供最佳方法。方法通过观察不同种类的自动消色笔书写在不同纸张上,保存在不同环境下的笔迹的消色过程、消色时间,分析判断消色笔书写笔迹的基本特性。使用文检仪、静电压痕仪、不同浓度的氢氧化钠溶液显现消色笔迹,比较不同显现识别方法的特点及优劣。结果不同的显现方法各有优劣,使用氢氧化钠溶液显色效果的最佳浓度为1.0 mol。结论在自动消色笔书写笔迹的显现中,可以根据不同情况,选择合适的显现方法达到识别检验的目的。

"入世"之后,由于政府职能的转变和激烈竞争的要求,我国将面临较大的人力资源缺口,尤其是在外贸、外语、金融、环保、谈判等方面,人才缺乏,必须尽快进行卓有成效的人力资源开发,才能应对因"入世"带来的各种挑战.

具有前置物的枪弹创射入口的形态学研究

对11例枪弹贯通障碍物后射入人体所形成的射入口的形态进行了观察与研究。结果表明，有前置物的射入口与单纯枪弹射入口的形态有明显不同，且受多种因素影响，形态各异。根据11例有前置物的射入口形态特征，分为混合及单纯两种类型，并对其形成机理、诊断依据以及实际应用意义进行了讨论。     

中国加入WTO与政务公开制度之构建

WTO透明度原则必将要求并推动我国政务公开制度的构建和完善。政务公开对保护公民基本权利,发展社会主义民主政治,消除腐败,创造公平公正、廉洁透明的发展环境等有着举足轻重的作用。与有关国家相比,我国的政务公开制度还比较落后。"入世"加速了我国市民社会的成熟和发展,行政观念的转变,社会信息化程度的提高,对构建完善我国政务公开制度提出了迫切要求。要借"入世"契机,培植法治社会价值理念,加速政务公开制度创新。
