Abstract

Legislatures in separation of powers systems like the US are often portrayed as having far greater capabilities and willingness to change defence policy than are parliaments in Westminster systems. This paper uses principal?agent models and hypotheses on legislative will to review the role of defence committees in the US Congress and Britain’s parliament during each country’s most recent, significant change in civil?military relations. Congressional committees drafted the 1986 Goldwater?Nichols Act over the objections of the president, fundamentally changing US civil?military relations. We would expect the British House of Commons to be at the opposite end of the spectrum, unable and unwilling to act without the prime minister’s blessing. At first glance, this is indeed what happened during Britain’s 2011 Defence Reform effort. Parliament took no concrete, independent action. A closer examination, however, suggests that parliamentary committees helped set the agenda for the 2011 reforms. These results point to the need to carefully assess both legislative capabilities and will when examining the role of legislatures in foreign policy, as well as the indirect means by which parliaments affect security policy.  相似文献

Institutional reform or development happens when those within the organisation want that development and are willing to commit the time, effort and necessary resources under their control to support it. This may be referred to as the will for development. Over the years, a general strategy for legislative development has emerged in which the will for development is enlisted in one or more of three ways: mapping, incentivising, and creating demand. These efforts focus on identifying the will for development independent of the legislative strengthening project itself. This paper will explore how success in supporting the budget process by the United States Agency for International Development-funded Afghanistan Parliamentary Assistance Programme enhanced and/or created the will for further development within that legislature. The paper will demonstrate how budget process support can be used to engage a broader constituency of committees and civil society organisations, creating a self-sustaining reform dynamic to be referred to as the demand dynamic.  相似文献

Over the past 15 years petitions systems have become embedded in the Scottish Parliament and the National Assembly for Wales, and more recently the House of Commons. This article uses the concept of procedural justice, with its emphasis on the fairness of the process by which decisions are made, as an analytical tool to explore four case studies of petitions systems in British legislatures, considering, in particular, the extent to which they enable voice, decision-making and transparency. It illustrates that the application of ideas of procedural justice not only provides us with a useful tool for analysing petitions systems in representative political institutions, but also potentially provides a framework of ideas from which petitions systems, and perhaps other participatory initiatives, may learn.  相似文献

Legislatures have long served as the fundamental organ of democratic rule. They bring together disparate views and competing preferences in one venue as an effort to introduce a equitable means of compromise to produce policies that affect those whom legislatures represent. They also check the authoritarian tendencies of other government actors, notably the executive, and create the conditions for institutionalised, rather than violent, debate. The legislatures of democratic Asia are no different. In this paper, I evaluate popular support for assemblies across the democracies of Asia, in terms of their legitimacy and use as a check on power. Traditional measures of support, including age, education, and liberal values, indicate growing support for legislatures. However, the significant effects of economic evaluations and the limited attachment to political parties suggest that the legislatures of Asia are still far from consolidating their role as assemblies that support democratic regimes in the region.  相似文献

This paper uses the natural experiment of seat allocation in the first Czech Senate to assess the effects of incentives on legislative effort. Contrary to previous work using similar research designs, the incentive of longer terms has little effect on the effort levels of legislators. This may reflect the parliamentary context, the newness of the Czech Senate, or, most interestingly, political culture.  相似文献
