掩饰、隐瞒犯罪所得、犯罪所得收益罪构成新析

掩饰、隐瞒犯罪所得、犯罪所得收益罪是妨碍正常司法活动秩序的犯罪,是故意犯罪。2009年11月11日起正式实施的《最高人民法院关于审理洗钱等刑事案件具体应用法律若干问题的解释》又对本罪作出了具体界定。本罪的主体不包括本犯,主观方面是明知的故意,犯罪对象是涉及财产性所得及利益犯罪的所得和收益,行为方式要求能起到掩饰、隐瞒的效果。《解释》的实施对本罪构成特征的重新认识和保护法益的探究,能达到澄清理论和推动实践的效果。

侵犯公民个人信息犯罪的司法认定

《刑法修正案（七）》增设的侵犯公民个人信息犯罪包括出售、非法提供公民个人信息罪和非法获取公民个人信息罪两个罪名。对个人信息的理解应从广义上把握,即将个人隐私也纳入个人信息的范畴。两罪所要求的情节严重具有各自不同的内容,而不应统一解释。对事前无共谋,事后帮助他人出售非法获取的信息的行为,应以掩饰、隐瞒犯罪所得罪定罪处罚。     

掩饰、隐瞒犯罪所得、犯罪所得收益罪司法实践若干疑难问题探析

从构成要件该当性、保护法益侵害性、刑法介入正当性等方面进行层进式分析,应当认定居间介绍盗窃者与被害人买卖赃物的行为构成掩饰、隐瞒犯罪所得罪。上游犯罪与掩饰、隐瞒犯罪所得、犯罪所得收益罪合并进行诉讼,能够在全面把握共生犯罪的同时查明派生犯罪的前提性事实,准确认定犯罪,防止出现撼动刑事诉讼法无罪推定原则的情况。将犯罪所得或者犯罪所得收益达到50万元以上理解为掩饰、隐瞒犯罪所得、犯罪所得收益罪“情节严重”的数额标准,具有解释论上的合理性。     

罪与非罪：刑法第362条之再理解

应用体系解释的方法，对刑法第362条进行分析，认可发现该条所规定的“通风报信对象”不应包括“违法行为人”，而只应是“犯罪的人”。这样的理解有助于刑法与行政处罚法相衔接。同时，由于时代的变化，刑法第362条对特定行业的限定应该得到修改或者取消。
