新发展阶段实施文化产业数字化战略探究

党的十九届五中全会提出了加快数字化发展的新要求。文化产业数字化有助于扩大内需,满足人民对美好生活的需求;有助于转变经济发展方式,扩大就业;有助于提高文化竞争力,增强文化软实力。转变观念,树立“互联网+”思维;充分发挥市场经济的作用,加强文化体制改革;加强科学规划,完善政策体系;制定并完善适应文化产业数字化发展的法律法规;重视对新型文化业态中的人才培养,为新发展阶段文化产业数字化战略实施的有效路径。     

著作权延伸性集体管理制度的中国化构建——以比较法为视角

源于北欧诸国著作权法上的著作权延伸性集体管理,将本由集体管理组织与使用者之间的作品使用合同依法延伸适用于非会员权利人。因该制度涵盖面广、可降低交易成本等显著特点,目前已成为世界各国解决数字化环境下作品海量使用授权问题的首选立法方案。我国《著作权法修订草案(送审稿)》引入了此项制度,但颇具争议。引入著作权延伸性集体管理制度符合我国国情,但需谨慎移植,删除《著作权法修订草案(送审稿)》第63条"其他方式"的表述,增加集体管理组织的通知义务;在第74条中增加,在非会员权利人起诉使用人侵权,法院判决使用人支付赔偿时,"集体管理组织应向使用人退还所收取的使用费"。     

Cyberspace Effects on Civil Society. The Ultimate Game-Changer or Not?

ABSTRACT

The article studies the effects of the emergence of cyberspace, or digitization, on civil society, and develops an analytical framework to that effect. It is distinguished between four types of civil societies: apolitical, political, transnational, and uncivic. Each type of civil society is considered separately vis-à-vis cyberspace developments in order to understand what kind of civil society is enhanced by these developments and, conversely, what kind of civil society is constrained. This understanding helps inform how cyberspace has changed the more generic society-state relations. While one can identify many instrumental changes and developments in civil society practices, the article concludes that the emergence of cyberspace has not profoundly changed society in terms of the relative power of one type of civil society over another. Thus, its transformative power is rather limited in a more fundamental sense. The empirical focus of the article is on Norwegian civil society, representing a Western developed democratic state, but it is argued that while the empirical results may vary, the analytical framework can arguably be applied and tailored to any society.

Slide-writing as Site-writing: A Performative Reading of the Women’s Art Library Slides

Abstract

The artist’s 35?mm slide consists of a photographic image framed by a slide mount she inscribes with writing and symbols that direct the slide’s future use. In this article, I consider how these artists’ writings that are held, suspended, in the WAL slide collection are a vibrant reading material that performs the slides as a feminist text. In my joint role as curator and researcher, I explore how I used photography to initiate a performative reading of the slide collection that politicizes the work of image reproductions.

The Big (Data) Bang: Policy,Prospects, and Challenges

Big data is increasingly the cornerstone on which policy making is based. However, with potential benefits and applications come challenges and dilemmas. In this set of symposium articles, authors examine the promise and problems of big data, exploring associated prospects, risks, parameters, and payoffs from a variety of perspectives. The articles address myriad challenges in the handling of big data sets, such as collection, validation, integrity, and security; ontological issues attending data analytics and conceptual transformations; the foundations of big data collection for social science research; the gap between the acquisition of data and its use to advance discovery and innovation; the costs and benefits of using big data in decision making and analysis; and, finally, related problems of privacy, security, and ethics. Issues such as these will continue to arise with increased use of big data as fundamental to policy making and governance in today's growing information society.
