| 摘 要： | 结合中国社会科学院知识产权中心的专家建议稿和国家版权局2012年3月31日公布的著作权法修改草案,讨论了著作权法修改中的一些问题,包括废除《计算机软件保护条例》、重新梳理著作权的权利体系、突出规定相关权,以及强化对于著作权和相关权的保护.我国《著作权法》的第三次修改,应当面向实务,解决问题,促进文化产业的发展.

| Abstract: | This paper,based on the "Expert Suggestions for the Third Amendments of the Copyright Law of China" by Intellectual Property Center,China Academy of Social Sciences,and the Drafting Amendments of the Copyright Law of China by National Copyright Administration of China,discusses some issues in the revision of the Law,including to delete "Regulations for the Protection of Computer Software";to rearrange author’s moral rights and economic rights;to clarify the related rights concerning performance,sound recording,broadcasting,and typographical design;and to strengthen the protection of author’s rights and related rights. |
