| 摘 要： | 特殊侦查措施是一种非常规、非常态的侦查措施，在刑事侦查中被有限地使用，以实现打击犯罪的目的。《联合国反腐败公约》认可在职务犯罪侦查中采用特殊侦查措施，但是中国法律并未确认之。鉴于职务犯罪的特殊性，同时为了使侦查机关在侦查过程中居于优势地位，有必要在中国法律中确认特殊侦查措施。特殊侦查措施的适用应该要符合实体法和程序法的规定，遵循法治原则，避免由于采用特殊侦查措施而侵犯公民的合法权益。

| Abstract: | The special inquisition measure is unconventional, un-normal and not used widely to effectively fight again crime. United Nations Convention against Corruption admitted the special inquisition measures, but Chinese laws didn＇t adopt it. Because the specialty of duty crime, and in order to put the inquisition organs into a superior position, it is necessary to admit special inquisition measures. However, the application of special inquisition measures should abide by the substantive law and procedure law, avoiding doing harms to people＇s interest. |
