传统司法制度价值的一点反思

中国的司法改革是一项涉及诸多复杂问题的社会系统工程。中国的司法改革应该把司法制度自身的变革和外部社会环境的培育和改造两方面结合起来。在变革现有司法制度的时候,一方面要充分移植和吸收西方先进的司法制度和理念,同时不应忽视本民族的传统司法制度。中国传统司法制度在当今的司法改革中有以下价值:认同、互补、借鉴和反思。
