| 摘 要： | 牵连犯在刑法理论中具有重要地位，但由于种种原因，它却造成了理论上的混乱和争议，并引起其本身的存废之争。牵连犯概念具有存在的合理性，并与其他概念有本质不同，不宜将其划入其他犯罪形态。

| Abstract: | Implicated violation theory is important in the criminal law.However,for various reasons it actually has created the theory confusion,the dispute and the struggle about it whether exists or not.Implicated violation has its existence rationality,and has differences with other concepts.So it is not right to include implicated violation within other crime shape. |
