| 摘 要： | 警察权主要有两大职权,即警察行政职权和警察刑事职权。警察权的本质是行政权。对警察权本质的分歧,主要在于侦查权的性质。无论是从侦查主体、侦查程序的运作、侦查的价值和功能方面看,侦查权都应归属行政权。
