外国公职人员受贿的刑法规制

运用国内刑法惩治外国公职人员受贿,这是《联合国反腐败公约》中规定的内容。相比之下,我国刑法中对外国公职人员受贿的规定还属于起步。文章对《公约》进行了分析,认为我国刑法中应补充规定外国公职人员和国际公共组织官员受贿罪的罪状和罪名,调整受贿罪的法条规定,以完善我国的刑法。

Criminal Regulations on Bribery of Foreign Public Officials

It has been stipulated that domestic criminal law can be used to punish foreign public officials for accepting bribes in ＂United Nations Convention against Corruption＂.However,the is just making a beginning.This article analyzes the Convention and points out that the counts and charges of bribery of foreign public officials and officials of public international organizations should be stimulated as a supplement and adjust the laws of bribery so as to improve criminal laws.
