| 摘 要： | 工伤事故赔偿的模式不管在理论界还是司法实践中,长期以来都是有争议的话题。针对目前各国采取的几种典型的赔偿模式进行分析对比,补充模式具有更大的合理性,我国应加以采用。目前我国工伤事故赔偿模式并不明确,相关法律模糊不清,甚至相互冲突。协调理顺法律之间及其与司法解释之间的矛盾,才能从根本上解决工伤赔偿模式的现实困惑。

| Abstract: | Industrial accidents compensation mode has long been a controversial topic.After comparing the several current typical compensation pattern,we conclude supplementary mode has greater rationality and should be adopted.China＇s current industrial accident compensation mode is not clear.Only by coordination between the law and its judicial interpretation,can we solve the reality of workers＇ compensation mode confusion. |
