| 摘 要： | 《刑法修正案（八）》已将单纯的醉洒驾驶行为单独入罪,但是并没有＂情节恶劣＂的限定。实践中应将醉酒驾驶造成后果的严重程度予以排列,对醉酒驾驶行为作出合理量刑,进行刑事处罚。

| Abstract: | The 8th criminal law amendment has formulated the drink-driving to be a crime without the limitation of situation of ＂Being Abominable＂.In the practice,the results of drink-driving should be arranged by the severity,and then the behavior will be sentenced properly and got criminal penalty. |
