| 摘 要： | 法律思维是法律职业者的内在特征,而其中以法官思维为代表。文章从“应然”的角度作了描述,认为法官在审理案件时应具有独立判断、中立、保守、信仰法律、以人性恶为起点,和促进社会福利六个方面的思维。

| Abstract: | Legal thinking is an inherent characteristic of the legal job person, and regard judge's thinking as representatives among them . This text has been described from the angle that " should be right ", think judge should have judge , neutrality , guarding , believing in lawing , understanding history , regarding human nature evil as the starting point independently while hearing a case, with promoting the thinking of six respects of social welfare. |
