| 摘 要： | 我国《刑事诉讼法》对被害人在公诉案件侦查阶段的诉讼权利规定较少,这与被害人的当事人地位不相称,在司法实践上很难充分保护被害人的合法权益。立法上应当完善被害人在此阶段享有的诉讼权利,以充分保护被害人的合法权益,实现社会正义。

| Abstract: | The regulations about the lawsuit right of the victims in investigating cases of public charge are few in Chinese Criminal Procedure Law. This does not match with the party status of the victims. It is difficult to protect the legal rights of the victims adequately in justice practice. The lawsuit right should be perfected in lawmaking in order to realize the social justices. |
