| 摘 要： | 近年来,随着物流运输业的繁荣发展,物流运输过程中的交通事故发生频率呈现上升趋势。交通事故发生后货车货品散落引发的哄抢行为案例屡见不鲜。笔者从交通事故发生后的哄抢行为典型案例入手,依据哄抢行为的法学概念,深入剖析哄抢行为当中哄抢参与人的主观意识及行为对货主损失带来的影响,分析哄抢参与人在哄抢事件中应当承担的法律责任,从而进一步探究哄抢事件中民警处置策略及法理学启示。

| Abstract: | In recent years, with the prosperity and development of logistics and transport, the frequency of accidents is rising in the logistics and transport process. Looting behavior is not uncommon after a traffic accident. The author started from a typical case of looting behavior after the traffic accident, according to the legal concept of looting behavior, in-depth analyzed the impact of the looting people＇s subjective awareness and behavior on the owner＇s losses in the looting behavior and the legal responsibility they should bear, to further explore the disposal strategies of the police in the looting incident and jurisprudence inspiration. |
