| 摘 要： | 通过对比较法方法论发展的历史沿革的研究,引出了功能比较的定义,并以中外立法监督制度为例,详细论述了功能比较的三个步骤:确定问题、收集材料;分析比较,探究原因;作出评价,提出建议。并对功能比较方法的优劣作出了恰当的评价。

| Abstract: | By the study of historic development of methodology of comparative law, the definition of functional comparison is given, and also by examples of foreign countries' legislation supervision styles.The first procedure of functional comparison is find the question and collective materials, the second is analyze and compare , the third is study the cause and make the conclusion. At the final part of the paper , it gives the advantage and weakness of this kind of method in the study of comparative law. |
