监狱行刑理念创新研究

监狱行刑理念是整个监狱制度的核心和灵魂,是监狱文明发展强有力的引擎。监狱行刑理念创新就是以实现行刑公正最大化为目标,以建设现代化文明监狱为主线,对传统监狱行刑理念与实践进行审视与反思,经过新旧互动、中外兼容和优胜劣汰,逐步建立与不断发展的经济基础和上层建筑要求相适应、与社会主义法治理念相统一的现代行刑理念。目前,我国传统的监狱行刑理念存在的弊端日益凸显,因此,需要超越传统行刑理念,以促进行刑理念的现代化。

The prison execution idea is the core and soul of the entire prison system,is a strong engine for civilized development.The prison execution idea innovation is to realize the execution of justice maximization,and make the modern civilized prison construc- tion as the main fine,and then review and reflect the traditional prison notion and practice,establish and development modern exe- cution idea which is economic basis adapted to the requirements of superstructure and unified with the concept of socialist rule of law,in the process do well in interaction of new and old compatible,compatibility of Chinese and foreign,and the survival of the fittest. At present , China＇s traditional prison execution idea existence malpractice is becoming increasingly prominent,beyond the tra- ditional concept of execution of modern vision is most recognized.
