权利是主体在谋取和实现利益的过程中所产生和拥有的并得到特定社会确认和保障的资源 ,义务是人们在特定社会中通过利益的反射所付出的成本 ,是以期望和信任关系为依托 ,并以规范化了的行为为表现的自我职责和社会职责的统一体。法律意义上的权利和义务就是这种一般意义上的权利和义务在法律领域里的特殊化和具体化。
