试论郊区生态环境保护与建设法律制度的完善

郊区被纳入到城市区域经济圈中，但郊区生态环境比城市和偏远的农村更加恶化，原因就是郊区的法律性质是农村，而中国环境资源法律制度实质上存在城市与农村的二元结构，因此，要保护和建设郊区生态环境，长期而言，必须消灭城市与农村利益的相互封闭、对立，从而消除环境资源法律制度存在的二元结构。当前则应当以城市区域经济圈作为城市的边界，在城市区域经济圈实现市区与郊区法律性质和适用法律一致。还要加强城市环境功能区划，建立公益诉讼制度等。

Improvement of Law System Construction and Eco- environmental Protection in Suburban Areas

The suburb has been brought into the urban economical circle,but the suburban ecological environ- ment is deteriating much worse than those in urban and rural areas,because of the rural legal nature of the suburb and the actual dual structure of the law system of environments and resources.In order to protect and improve the ecological environments of the suburan areas,it is absolutely necessary,in a long period of time,to wipe out the closeness and confrontation of the interests between cities and countrysides,thereby get rid of the actually existing dual structure of the legal systems of environments and resources.Currently we should take the urban economical circle as the boundary of cities to realize the conformity of legal nature and application of suburb and urban areas in the city economical circle,strengthen the plan of the environmental functions of cities,and establish the legal sys- tems of public benefit actions,etc.
