| 摘 要： | 环境侵权的出现发展了传统侵权行为归责原则,各国逐步采用了无过错责任作为环境侵权的归责原则。但由于环境侵权的多样性、特殊性和复杂性,无过错责任原则不能完全适应变化多端的环境侵权类型,应当建立起以无过错责任为主,公平责任、风险责任和过错责任为辅的归责体系,方能适应现实生活需要。

| Abstract: | The emergence of environmental tort enforced the development of traditional imputation principles, and countries progressively took liability without fault as environmental tort imputation principle. But because the variety, peculiarity and complexity of environmental tort, principle of liability without fault can not adapt to changeful types of environmental tort completely, therefore, in order to meet the needs of real life, we should set up a new imputation system which mainly relies on liability without fault, and complemented by fair responsibility, liabilities ascertaining and fault liability. |
