论一物一权原则及其与“双重所有权”理论的冲突

一物一权原则仅指一独立物之上只能而且必须设定一项所有权 ,集合物得成为一项交易的标的 ,但不能也无必要成立单独的所有权。双重所有权的理论扭曲了所有权的概念和性质 ,必然导致公司与股东人格的混同。
