摘    要:恶搞成了2006年中国最流行的词汇。从法律的角度审视,恶搞是公民行使言论自由这一宪法权利的一种具体形式,国家应当保障公民以恶搞这种方式充分行使言论自由权;同时,公民不得以恶搞的方式损害国家的、社会的、集体的利益和其他公民的合法的自由和权利。恶搞作品不是著作权法规定的演绎作品,而是滑稽模仿作品,它不侵犯被恶搞者的著作权。

Abstract:Spoof, or the Chinese slang term "E-Gao", was the most popular word in China in 2006. From a legal perspective, spoof is the reflection of the constitutional right, with which citizens exercise their right to the freedom of speech and so should be protected by the state when citizens fully exercise their right to the freedom of speech in the form of "E-Gao". And in no way should citizens infringe upon the interests of the state, the society, the collective or the legitimate freedom and rights of other citizens. Works of spoof are not derivative works as are defined in the Intellectual Property Law, but works of parody, which do not infringe upon the copyright of original writers.
