建立与完善我国行政公开制度的对策探析

行政公开是20世纪中期以来西方各国行政发展的重要趋势。行政公开是民主政治的基本要求,是依法行政的本质反映。它通常与知情权相对应。我国宪法规定,中华人民共和国的一切权力属于人民,人民是国家的主人。从这一角度出发,我们可以把行政公开理解为是政府的义务,知情权是公民的一项宪法权利。建立与完善行政公开制度是现时代的迫切需要,是一项复杂而艰巨的系统工程。

Countermeasure of setting up and perfecting administrative opening system of our country

Administrative opening is the important trend of west countries administrative development since the middle of 20 century, administrative opening is the basic demand of democratic politics and the reflection of the nature of administration by law. Ordinarily it is related to the right to know . In our constitution , all of the privileges of PRC belong to the people and the people is the master of our country. From this aspect , we may consider administrative opening as the duty of the government . The right to know is the constitutional privilege of our citizens. Setting up and perfecting administrative opening regulation is urgent need of our days and a complicated and difficult systematic project.
