犯罪既遂问题研究

犯罪既遂是犯罪的一种基本形态,学界关于犯罪既遂的标准存在着争论.在司法上,应当坚持罪刑法定原则,以"犯罪构成要件要素齐备说"作为认定犯罪既遂的标准;在立法上,则应当从犯罪事实和刑事政策的角度出发,以"犯罪目的实现+刑事政策说"作为确立犯罪既遂形态的标准.

Study of Accomplishment of Crime

The accomplished offence is a basic form of a crime.There is controversy on the standard of crime completion in theoretical circles.In the judicial,we should adhere to the principle of legality,take the theory of complete elements that constitute a crime as a standard of guilty completion;While in the legislation,it should be in the criminal facts and criminal policy perspective,take the theory of achieving criminal intent and criminal policy theory as standards to clear accomplished crime.
