| 摘 要： | 行政犯罪已经发展成为我国当前的一种重要犯罪形态。而我国现行刑罚结构与刑种设置更加契合传统刑事犯罪的特质，因此，以提高刑罚实效为目标，以处遇行政犯罪为突破口，有针对性地对现行刑种设置进行适当调整是本文主要的论证主旨。

| Abstract: | Administrative crime has become a very important kind of crime in China.The current Chinese punishment structure and kind setup fit more to the trait of traditional criminal crimes.This paper mainly discusses about how to properly adjust the setup of punishment kind by taking handling administrative crime as the breakthrough point with the aim of improving punichment effect. |
