联合国《国际汇票及本票公约》中的票据抗辩

作为票据法国际统一活动的最新及最重要的成果——联合国《国际汇票及本票公约》，已在1988年通过并于1990年开放签字，但我国大陆至今仍无比较集中的研究文献面世。虽然该公约的适用范围仅限于“国际票据”，并不是同时适用缔约国国内的票据法规范，但是，对其加以研究无论对于我国参与国际经济往来时票据的运用，还是我国将来国内票据立法的修改，都是必要的。因为该公约内容表现出的对两大法系差异的取舍，主要体现在票据抗辩制度的设计上，探讨该公约中作为票据流通保护的票据抗辩和善意取得制度的基本内容，并勾勒抗辩排除规则的基本构造十分必要；同时，因为该公约的内容和形式过多地反映了英美法的特点，所以以日内瓦法传统的抗辩分类体系对公约的规定予以解说，以减少我国学者对公约的抵触感。比较分析两大法系与该公约相关内容，检讨我国的现行相关制度，并以此努力拓展票据法的研究视野。
