| 摘 要： | 禁止重复评价中的行为与“一星管二”中的行为是不同的概念,两者是并行不悖的关系。想象竞合犯是数个犯意支配下的数个犯罪行为分别触犯不同的罪名,因此,想象竞合犯是实质上的数罪而不是实质上的一罪。

| Abstract: | The act that no appraising repeatedly is not the same concept with the appraising repeatedly, both of them are not mutually relation; Imaginative joinder of offenses is the crime which several acts with several criminal intents violate the several criminal laws, so, imaginative joinder of offenses is plural crimes in effect, not the one crime. |
