| 摘 要： | 法体系内刑法条款和宪法发生冲突实属必然,此时该刑法条款有违宪之嫌。但是不能简单地付诸刑法修改,而是尽量在刑事一体化的框架内解决。应采取刑法的合宪性解释、刑法的合宪性推定、暂时搁置争议等方法尽量消解冲突,维护宪法和刑法的权威。

| Abstract: | It's inevitable for some clauses of criminal law go against the constitution,which could be interpreted as in violation of constitution.But it couldn't be solved simply by modify the criminal law.An integrated resolution which includes constitutional interpretation and presumption of criminal law,as well as suspend controversy temporarily,should be adopted to guard the dignity of both the constitution and the criminal law. |
