| 摘 要： | 回族群众的法观念和法行为中，既有伊斯兰教法及其习惯法的内容，也有国家法和汉族传统文化的内容。在国家法治不断强化、全面渗透到社会生活各个方面的过程中，回族继承习惯法与国家继承法之间不可避免地产生了一定的冲突。正确认识冲突现象，分析冲突存在的原因，找到解决冲突的方法，是促进国家继承法在少数民族地区施行，确保社会和谐发展的重要保障。

| Abstract: | There have contents of Islamic law and its customary law as well as those of state law and traditional culture of Han nationality in law idea and law behavior of the Hui people. In a process of continuous enhancement of state law system and its comprehensive penetration into social life, some conflicts inevitably appear between customary law of Hui nationality and state heritage law. It is an important guarantee of the promotion of the implementation of state heritage law in minority areas and of assure of social harmony to correctly understand the conflicts phenomena, analysis their mains and find the solutions. |
