人民警察行使开枪权探究

人民警察的开枪行为历来为社会各界所关注,而当前有关法律法规对人民警察行使开枪权的规定还存在一定问题,诸如警察开枪的合理界限是什么,怎样保障警察正确行使开枪权?这些都是研究警察开枪问题的重要内容。借鉴其他国家或地区有关警察行使开枪权的立法经验,应修订我国现有法律法规,并加强配枪人员实战训练与改进现有枪支配备,使人民警察在法定情形下敢于开枪、依法开枪、合理开枪。

The people’s police’s shooting behavior has always attracted attentions from all sectors of society, while the current relevant laws and regulations still exists certain problems for the regulation of their right to shoot, such as what is the reasonable boundaries, and how to guarantee shooting rightly, which are all the important contents of the research. Compared with the legislative experience of other countries, we should revise China's existing laws and regulations, strengthen the police’s guns actual combat training, improve the existing guns equipment, and enable the people's police in legal cases to shoot, and shoot in accordance with the law.
