高校职务科技成果混合所有制的困境与出路

高校职务科技成果混合所有制,是我国赋予科研人员科技成果所有权,促进科技成果转化的重要探索。但是,现行方案不仅违反上位法关于职务科技成果权属的规定,而且对产权混合所有的固有缺陷也缺乏应对方案。高校职务科技成果权利配置应当以利益平衡为核心,以促进科技成果转化为导向。我国应当在扩大解释高校职务科技成果处置权的基础上,赋予当事人权属自治的自由;同时完善高校职务科技成果混合所有权的行使规则与权责体系,以解决当事人契约不完备的问题。

Dilemma and Outlet of Mixed-Ownership System of Scientific and Technological Achievements in Colleges

In China,the mixed ownership system of the service scientific and technological achievements in colleges and universities is an important exploration to empower R&D personnel to take ownership of the S&T achievements.However,the current legal framework not only violates the provisions of higher-level law on the ownership of the service S&T achievements,but also lacks a solution to the inherent defects of joint ownership.The allocation of rights on S&T achievements in colleges and universities should focus on the balance of interests and promote the implementation of the achievements.Therefore,autonomy principal as with regards rights disposal of the ownership of S&T achievements should be established on the basis of expanding the interpretation of the right to dispose of S&T achievements in colleges and universities.Meanwhile,the rules of implementation and the provisions concerning the rights and responsibilities of relevant parties shall be developed to solve the problems of unclear agreements.
